Agenda Item: 13 CITY OF SANTA CLARITA AGENDA REPORT CONSENT CALENDAR City Manager Approval: Item to be presented by: Frank Ferry DATE: June 28, 2011 SUBJECT: WITHDRAWAL OF THE HASLEY HILLSNALENCIA COMMERCE CENTER LAFCO ANNEXATION APPLICATION DEPARTMENT: City Manager's Office RECOMMENDED ACTION City Council direct and authorize the City Manager to submit a letter to the Local Agency Formation Commission to withdraw the Hasley Hills/Valencia Commerce Center annexation application. BACKGROUND Per the request of Councilmember Ferry at the June 14, 2011, City Council meeting, the City Council directed staff to place this item on the City Council agenda. On April 22, 2008, the City Council of the City of Santa Clarita unanimously approved the Hasley Hills/Valencia Commerce Center Annexation (Resolution 08-35) and authorized the filing of an application for annexation with the Los Angeles County Local Agency Formation Commission (LAFCO). An application was subsequently filed with LAFCO. The annexation area includes the residential neighborhoods of Hasley Hills, Live Oak, North Bluff, and the Valencia Commerce Center, consisting of approximately 1,430 acres of land generally located at the northwest corner of I-5 and SR -126. More specifically, the annexation included 808 acres.of industrial area, 48 acres of commercial area, 571 acres of residential area, and 5.36 acres of open space area. Since filing this annexation nearly three years ago, several factors and considerations have intervened that now make it appropriate to consider withdrawal of this proposed annexation. These factors and considerations are explained below. The Hasley Hills/Valencia Commerce Center annexation was commenced after residents of the three neighborhoods submitted petitions containing the signatures of a super majority of homeowners and businesses. Since that time, this proposed annexation has become contentious dPP VED and controversial. Opposition to this annexation has been expressed by the Castaic Area Town Council, the Castaic Chamber of Commerce, Newhall Land and Farming; Supervisor Michael D. Antonovich, the Valencia Commerce Center Association, and the West Ranch Town Council. It has become clear that a "community consensus" does not exist at this time in support of this proposed annexation. As with the prior annexations completed by the City of Santa Clarita, it is desirable to achieve such a community consensus regarding this, and any other, proposed annexation. Lack of a community consensus is counterproductive to our desire to facilitate a positive relationship between the City of Santa Clarita and Westside community organizations. A major issue of disagreement is that of "community of interest" and whether this proposed annexation would divide a community that has a strong sense of identity. While many homeowners and business owners within the proposed annexation area have expressed their opinion that this annexation would not divide a community of interest, many residents and business owners from the greater Castaic area have expressed their opinion that this proposed annexation would indeed divide a community with a strong sense of identity. The issue of "community of interest" should be resolved and a consensus achieved before annexation of this area can be reconsidered. Facilitation of discussions that over time could lead to a consensus on the issue of community of interest is hampered by the pending Hasley Hill/Valencia Commerce Center annexation insofar as it can be interpreted as a presupposed outcome. While this proposed annexation has languished, residents of neighborhoods north and east of the City have expressed interest in annexation. In response, the City has engaged these neighborhoods to further survey their level of interest. As a result, we are processing annexations north and east of the City that would, when completed, significantly increase the size of the City in terms of population and square miles. These annexations, which are relatively non controversial, will require the attention and focus of the City Council and staff over the next few years as we deploy services to these areas. In consideration of the issues discussed herein, it is recommended that the City Council direct and authorize the City Manager to submit a letter to LAFCO to withdraw the Hasley Hills/Valencia Commerce Center Annexation application. This recommended action will permit the City of Santa Clarita, at the appropriate time in the future, to work with the Westside communities to build a community consensus regarding the future course of local government for the Santa Clarita Valley. ATTACHMENTS Map of Hasley Hills/Valencia Commerce Center Resolution 08-35 (Reading File) RESOLUTION NO. 08-35 A RESOLUTION OF APPLICATION BY THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, REQUESTING THAT THE LOCAL AGENCY FORMATION COMMISSION OF LOS ANGELES COUNTY INITIATE PROCEEDINGS TO AMEND THE SPHERE OF INFLUENCE AND FOR THE ANNEXATION OF CERTAIN INHABITED TERRITORY TO THE CITY OF SANTA CLARITA (MASTER CASE NO. 07-206 — SPHERE OF INFLUENCE AMENDMENT 07-001 AND ANNEXATION 08-005) WHEREAS, the City of Santa Clarita desires to initiate proceedings pursuant to the Cortese -Knox -Hertzberg Local Government Reorganization Act of 2000, commencing with Section 56000 of the California Government Code, for a Sphere of Influence Amendment and annexation on approximately 1,430 acres of unincorporated county territory; and WHEREAS, the territory proposed to be annexed is inhabited, and a description of the boundaries is set forth in Exhibit A, and a map of the boundaries is set forth in Exhibit B, attached and by this reference incorporated; and WHEREAS, the short form designation of the proposal is Sphere of Influence Amendment 07-001 and Annexation No. 2008-05 (Master Case No. 07-206), which includes the i area known as Hasley Hills/Valencia Commerce Center; and WHEREAS, this proposal is currently inconsistent with the City of Santa Clarita's Sphere of Influence as designated by the Local Agency Formation Commission, and would require amending thereof pursuant to this proposal; and WHEREAS, no terms or conditions are requested by the property owners; for this proposed annexation at this time; and WHEREAS, the reasons for this proposed annexation are to propose a logical extension of City boundaries, to respond to the property owners' request for City services and to promote sound land use and plaiuiing practices in the affected territory; and WHEREAS, the majority of property owners of the subject site have indicated consent to the annexation and as evidenced by written petition to the City; and WHEREAS, the City Council of the City of Santa Clarita has considered all evidence, oral and documentary, and is advised of the foregoing.
