APPROVE THE PLANS AND SPECIFICATIONS AND AWARD
CONSTRUCTION CONTRACT

RECOMMENDED ACTION
1. City Council approve the plans and specifications for the Lyons Avenue Median
Modification, Project C0026.
2. Approve the withdrawal of the bid by ASAP General Engineering and award the construction
contract to FS Construction in the amount of $209,404, and authorize a contingency in the
amount of $31,411, for a total contract amount not to exceed $240,815.
3. Increase revenues in the amount of $61,260 in Revenue Account 259-4451.004 and
appropriate $61,260 to Expenditure Account C0026259-5161.001.
4. Authorize the City Manager or designee to execute all documents, subject to City Attorney
approval.
BACKGROUND
This project will construct a raised landscaped median on Lyons Avenue from Interstate 5 to
approximately 800 feet east. Lyons Avenue is one of the City's oldest commercial corridors
developed before City incorporation and current planning guidelines. There are numerous
driveways in close proximity to each other within the project limits. Additionally, the Interstate 5
northbound on- and off -ramps include a free flow right turn onto eastbound Lyons Avenue. The
heavy left -turn movement in and out of these driveways combined with a traffic volume in
excess of 38,000 vehicles per day on Lyons Avenue has created a high -conflict area. This project
is a high priority due to the presence of safety issues with the current configuration of Lyons
Avenue.
A review of the collision history for this section of Lyons Avenue reveals that a total of 49
midblock collisions occurred over a 4 -year period, representing the second highest incidence of
midblock collisions in the City. Unsafe left turns in and out of these driveways are the most
common cause of accidents. The proposed raised median is a traffic safety measure to reduce the
traffic collisions in the area.
In February 2008, the City submitted a grant application for funds under the Highway Safety
Improvement Program (HSIP). HSIP is a federally funded program managed by the State of
California (State) with the primary purpose of mitigating high -collision locations. Cities and
counties are eligible to apply for this competitive grant, and projects with a high -safety index
rating are given priority. The Lyons Avenue median project was selected and awarded a HSIP
grant in the amount of $174,240. The City recently received an additional $61,260 in HSIP
funds.
The project has been thoroughly studied and designed to minimize impact to adjacent businesses
while addressing the collision patterns in the area. Additionally, staff has retained Consulting
Traffic Engineer, Mr. David Royer, for an independent review of the Traffic Engineering aspects
of the project. Mr. Royer has 46 years of traffic and highway engineering experience, including
over 36 years in the public sector. A copy of his report is attached (see Exhibit "A").
Staff has been informing affected businesses and property owners of the project's progress,
inviting them to share their concerns, and working with them toward potential solutions. A copy
of the recent outreach efforts by the City to the property owners is attached (see Exhibit "B"). A
total of seven businesses were contacted and four responded. Representatives of the Randall
Trust properties (Wendy's restaurant and 76 gas station) have expressed their opposition to the
project and cited that the left -turn restrictions will negatively impact their businesses. The
Chevron gas station and Summerhill Villa senior facility have expressed their support for the
project. Mr. David Wurts, property owner and business owner of Burger King restaurant,
expressed his opposition to the project in the past when it was initially discussed a few years ago.
Mr. Wurts, however, has not responded to staff s recent letters on the matter.
Two other alternatives were considered during the final design of the median improvements: (1)
modifying the intersection of Lyons Avenue and Interstate 5 northbound ramps and (2) an
alternative plan proposed by Randall Trust. Since the intersection of Lyons Avenue and Interstate
5 northbound ramps falls under the State's jurisdiction, the City submitted a request to Caltrans
to study the intersection for potential improvements to traffic movements. Caltrans rejected the
City's request to modify the Interstate 5 northbound off ramp to Lyons Avenue. A copy of the
Caltrans response letter is attached (see Exhibit "C"). City staff and Mr. Royer reviewed the
alternative plan submitted by Randall Trust's traffic consultant. City staff and Mr. Royer .
determined that this alternative plan does not address the collision concerns in the area. Staff
notified and provided an explanation to Randall Trust and Wendy's regarding the City's position
on their alternative plan.
The Randall Trust properties (Wendy's restaurant and 76 gas station) are accessed by two
driveways. The westerly driveway is restricted to right turns only and the easterly driveway has
no restrictions at this time. With the proposed median improvements, the left -turn movements at
the easterly driveway will be restricted. However, the proposed median will have a U-turn pocket
275 feet east from the driveway that will accommodate the inbound left turns to these properties.
It is important to note that in 1998, when the 76 gas station and Special K market were
developed, the westerly driveway was restricted to right turns only, but the easterly driveway was
subject to a Condition of Approval that allowed left turns, unless the accident history dictated the
left turns should be eliminated. Further, as part of the Conditions of Approval of the Wendy's
development in 2003, an access restriction was dedicated to the City for right turn in/out only
with the construction of a raised median. The covenant and agreement noting the access
restriction was recorded with the Los Angeles County Recorder's Office in 2003 and signed by a
representative of the Randall Trust (see Exhibit "D").
An invitation to bid was published three times (February 2, February 5, and February 9, 2011),
and was noticed on the City's website. Plans and specifications were also sent to area plan rooms.
Eight bids were submitted to the City and opened by Purchasing on March 15, 2011. The results
are shown below:

The apparent low bidder, ASAP General Engineering, sent a letter to the City requesting to
withdraw its bid due to clerical errors. The City Attorney's Office has reviewed the request by
ASAP to withdraw its bid and has found that the request is legally sufficient.
Staff recommends the project be awarded to FS Construction, the next lowest responsive bidder.
This contractor possesses a valid state contractor's license and is in good standing with the
Contractors State License Board. FS Construction's bid has been reviewed for accuracy and
conformance to the contract documents and was found to be complete.
While the City maintains a Support of Local Business policy that can be utilized by the City
Council when warranted, the City is governed by the California Public Contract Code with
regard to Public Works project procurement. In these types of procurement, the Public Contract
Code does not permit a city to utilize a Support of Local Business policy and instead requires the
contract be awarded to the lowest responsible bidder. As confirmed by the City Attorney's
Office, this direction precludes the City from applying any superseding criteria for award except
in the case of a tie. Thus, in the awarding of Public Works contracts, the City is not permitted to
award to the second low bidder just because they are local as the Public Contract Code does not
allow the City to recognize them as the "lowest" responsible bidder.
Expenditures in the amount of $68,137 are anticipated for construction management support,
staff oversight, labor compliance services, inspection services, materials testing, surveying, and
miscellaneous project administration costs.
ALTERNATIVE ACTIONS
Other action as determined by the City Council.
FISCAL IMPACT
With the requested appropriation, adequate Gas Tax funds, Highway Safety Improvement
Program funds, and General funds are available in the Fiscal Year 2010-11 budget in Accounts
C0026230-5161.001, C0026259-5161.001, and C0026601-5161.001.

Dear Andrew Yi
Pursuant to your request, I have performed an independent review of the Traffic
Engineering aspects of the Project. As part of my comprehensive review, I have
performed the following tasks:
• I reviewed the Signing, Striping, and Geometric Alignment plan for the Project.
• I reviewed the Traffic Collision History for the subject reach of Lyons Avenue for
the period of 2004 through 2010.
• I performed a field investigation of the subject reach of Lyons Avenue.
Review of the Striping, Signing and Geometric Alignment plan revealed that the plan is
consistent with established engineering guidelines. All of the turning maneuvers and all
of the traffic controls are in compliance with the guidelines. Also, controlling left turns
into and out of driveways has been documented by the Traffic Engineering profession,
nation wide, as a tool for reducing collisions and improving traffic flow. It is an excellent
plan to resolve the significant traffic problems of this area.
Review of the seven year traffic collision history revealed a si ,nificant pattern of
reported collisions in the area of the project. The high concentration of uncontrolled
driveways adjacent to a major freeway interchange has resulted in an extremely, high
number of Broadside and Rear -End collisions. We also know that in California less than
half of the Property -Damage -Only collisions are even reported. Of most importance is
the fact that Broadside collisions have the potential to cause extremely severe injuries.
My field investigation involved turning into and out of most of the driveways in this
subject area, as well as exiting the freeway utilizing the free flow traffic lane. During
peak hours and even during mid dui there are significant traffic conflicts that develop
while drivers are changing lanes and cutting across through traffic lanes to enter or exit
driveways. In most instances I could turn right while exiting a driveway and then make a
"U" turn to go the other direction easier, and certainly far safer, than attempting a left

turn. The same is true cutting across east bound traffic lanes to make a left turn into the
driveways on the north side of Lyons Avenue that are adjacent to the freeway.
In conclusion, I urge you to go forward with this project as soon a possible. It is an
excellent project that will significantly reduce the severe collision history of the area and
also improve traffic flow near this major freeway interchange. I have used these same
turn restriction tools when I was with the City of Los Angeles and found them to
significantly reduce the serious traffic collision patterns and actually improve the
business access for the area.

Dear Mr. Yi,
This is in response to your letter dated September 22, 2008 regarding the request to consider
modifying the I-5 northbound off -ramp to Lyons Ave, to include right -tum lane in the phasing of
the signal.
Currently, motorists using the northbound off -ramp have a free right turn onto the third lane of
the eastbound Lyons Ave. This is striped as a dedicated lane along Lyons Ave for approximately
250 feet past the intersection, to prevent / discourage traffic from merging into and out of this
lane.
Upon further review and analysis of the traffic accident data for this intersection, it is concluded
that majority of the accidents along this section of Lyons Avenue are attributed to unsafe lane
changes and 'illegal left and/or U-turns. These unsafe movements are expected to be reduced or
eliminated after the installation of the raised median. The northbound free right turn movement
does not contribute to these types of accidents.
Additionally, the removal of the free right turn would reduce the capacity and the efficiency of
the intersection and increase the potential of rear end accidents along the northbound I-5 off -
ramp. Therefore, the request to modify the I-5 northbound off -ramp to Lyons Avenue is denied at
this time.
