City Council approve the plans and specifications for the 2010-11 Overlay and Slurry Seal Program, Project M0077. 2. Award the construction contract to Toro Enterprises Inc. in the amount of $4,647,152, and authorize a 10 percent contingency in the amount of $464,716, for a total contract amount not to exceed $5,111,868. 3. Authorize an expenditure increase in the amount of $70,000 to the existing professional services contract with Pavement Engineering Inc. for pavement inspections and updates for the Pavement Management System. 4. Authorize an expenditure increase not to exceed $45,000 to the existing professional services contract with Pavement Engineering Inc. for roadway/asphalt-related design changes during construction. 5. Authorize the transfer of $130,000 from the 2009-10 Overlay and Slurry Seal Program Account M0071306-5161.001 to the 2010-11 Overlay and Slurry Seal Program Account M0077306-5161.001. 6. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval. BACKGROUND The Annual Overlay and Slurry Seal Program project is an integral part of the City's pavement management program. Each year, streets are evaluated and identified for their need for MRO�ED rehabilitation or maintenance treatments. The 2010-11 project will provide asphalt overlay, micro -surfacing, and slurry seal treatments in various areas of the City (see attached project streets list). These treatments will provide a smoother ride for traffic and enhance the appearance of the roadway and surrounding area. This year's project is scheduled to begin construction in July and be completed by the end of October 2011. An invitation to bid was prepared, published three times (April 17, April 24, and April 27, 2011), and noticed to the City's website. Plans and specifications were also sent to area plan rooms. Five bids were submitted to the City and opened by Purchasing on May 12, 2011. The results of the bids are shown below: Company Location Bid Amount Toro Enterprises Inc. The bid results shown above include all of the Additive Alternates. Upon review of the bids, staff recommends awarding the construction contract to the lowest responsive bidder, Toro Enterprises Inc., which possesses a state contractor's license and is in good standing with the Contractors State License Board. The bid from Toro Enterprises Inc. was reviewed for accuracy and conformance to the contract documents and found to be complete. While the City maintains a "Support of Local Businesses" policy that can be utilized by the City Council when warranted, the City is governed by the State Public Contract Code with regard to public works project procurement. In these types of procurement, the Public Contract Code does not permit a City to utilize a "Support of Local Businesses" policy and instead requires the contract be awarded to the "lowest responsible bidder." As confirmed by the City Attorney's Office, this direction precludes the City from applying any superseding criteria for award except in the case of a tie. Thus, in the awarding of Public Works contracts, the City is not permitted to award to the second lowest bidder just because they are local as the State Public Contract Code does not allow the City to recognize them as the "lowest" responsible bidder. Last year's paving project, 2009-10 Overlay and Slurry Seal Program, Project M0071 has $130,000 in savings that will be transferred to this year's project. Staff is seeking authorization of an expenditure increase not to exceed $45,000 for design services to the existing professional services contract with Pavement Engineering Inc. for roadway/asphalt-related design changes during construction. As part of the annual street maintenance project, the City also inspects and records the pavement condition citywide. Staff is seeking authorization of $70,000 for Pavement Engineering Inc. to continue pavement inspections and updates to the City's Pavement Management System. No new lane miles were accepted by the City in 2011 nor added to the system. The City is responsible for the maintenance of a total of 972 lane miles. 9 Adequate funds have been appropriated for construction management, survey, labor compliance, staff oversight, and project administration costs, as well as a future federal overlay project. ALTERNATIVE ACTIONS Other action as determined by the City Council. FISCAL IMPACT The 2010-11 Overlay and.Slurry Seal Program, Project M0077, budget is $7,865,262. The recommended actions will make available a budget of $7,995,262 for the 2010-11 Overlay and Slurry Seal Program to adequately provide for all anticipated construction and project management costs.
