MEMORANDUM OF UNDERSTANDING (MOU) WITH STATE
OF CALIFORNIA AND COUNTY OF LOS ANGELES

RECOMMENDED ACTION
City Council authorize the City Manager or designee to:
1. Enter into a Memorandum of Understanding (MOU) with the State of California Housing and
Community Development Department to accept the Final Designation and administer the Santa
Clarita Valley Enterprise Zone, subject to City Attorney approval; and authorize the City
Manager or designee to execute renewal options and supplemental documents to the MOU with
the State of California, subject to City Attorney approval.
2. Enter into a Memorandum of Understanding (MOU) with the County of Los Angeles
authorizing the City of Santa Clarita to administer the Santa Clarita Valley Enterprise Zone,
subject to City Attorney approval; and authorize the City Manager or designee to execute renewal
options and supplemental documents to the MOU with the County of Los Angeles, subject to
City Attorney approval.
BACKGROUND
The purpose of the Enterprise Zone program is to target areas throughout the State of California
to stimulate business and industrial growth. Special state and local incentives encourage
business investment and promote the creation of jobs within a designated area.
On July 1, 2007, the City of Santa Clarita was designated as one of 42 Enterprise Zones
throughout the State of California. Since the City was designated as an Enterprise Zone, this
program has helped create and retain more than 5,000 jobs locally. To date, more than 330
businesses in Santa Clarita have taken advantage of the tax savings program generating close to
$189 million in potential savings to local businesses.
On April 15, 2010, the State Department of Housing and Community Development issued a.
request for applications for Enterprise Zone designations to fill two expiring Enterprise Zones
statewide.
At the June 22, 2010, City Council meeting, Council directed staff to begin partnering with the
County of Los Angeles and the Santa Clarita Valley Economic Development Corporation to
submit an application for a reconfiguration and expansion of the City of Santa Clarita's existing
Enterprise Zone.
The application for a multi jurisdictional Enterprise Zone, to be called the Santa Clarita Valley
Enterprise Zone, was proposed to encompass approximately 14,441 acres of land. Of this total
acreage, approximately 73% or 10,609 acres is zoned commercial or industrial.
On December 15, 2010, the City of Santa Clarita was notified that the new proposed Santa
Clarita Valley Enterprise Zone had received conditional designation approval by the State and
that over the course of the next year would move from conditional to final designation.
On January 10, 2011, Governor Jerry Brown proposed the elimination of the Enterprise Zone
program statewide and halted all movement on any of the conditionally designated Enterprise
Zones in the State. After several months of lobbying by the Santa Clarita business community
and many of the other Enterprise Zone programs statewide, Governor Brown's proposal was
rescinded and the program began moving forward again.
On October 10, 2011, the State of California Housing and Community Development Department
issued a memo stating that they would actively review all Enterprise Zones in conditionally
designated status and work with the Zones to ensure that the necessary paperwork to move to
final designation status was submitted by no later than April 10, 2012.
The City of Santa Clarita currently administers the existing Santa Clarita Enterprise Zone that
was designated by the State in July 2007. The new Santa Clarita Valley Enterprise Zone will
replace the City's existing Enterprise Zone. The City will be the lead agency on administering
the proposed new zone and will work cooperatively with Los Angeles County on marketing the
benefits of the program as outlined in the attached MOU with the County of Los Angeles. The
City will be partnering with the Santa Clarita Valley Economic Development Corporation
(SCVEDC) on outreach to businesses promoting the Enterprise Zone. Marketing and outreach
within the City has been budgeted by the City Council for FY 11-12. Any additional marketing
and outreach in areas within unincorporated Los Angeles County would be funded by Los
Angeles County.
The City is required to enter into an MOU with the State of California to accept the final
designation and administer the Santa Clarita Valley Enterprise Zone. The State has supplied

draft language to the City of Santa Clarita for this MOU. It is expected that the MOU, once
approved, will be finalized by the State with a retroactive designation date for the Santa Clarita
Valley Enterprise Zone of January 1, 2011. The Santa Clarita Valley Enterprise Zone will
remain in conditional designation status until the MOU with the State is executed and all
requested supplemental documents are approved by the State.
The MOU between the City and State of California Housing and Community Development
Department is a contract outlining the responsibilities of the administering agency for the Santa
Clarita Valley Enterprise Zone. It embodies the goals identified and commitments made in the
application for the new Santa Clarita Valley Enterprise Zone submitted on September 15, 2010.
Performance of the MOU and compliance with regulations stated in the California Enterprise
Zone Act are the basis for passing or failing audits and continuance as an Enterprise Zone.

MEMORANDUM OF UNDERSTANDING FOR MULTIAGENCY COOPERATION IN
THE IMPLEMENTATION, MANAGEMENT AND MARKETING OF
THE SANTA CLARITA VALLEY ENTERPRISE ZONE
This MEMORANDUM OF UNDERSTANDING (hereinafter "MOU") is made and
executed this 13`h day of March, 2012 (the "Effective date") by and between the City of Santa
Clarita (hereinafter referred to as "CITY") and the COUNTY OF LOS ANGELES (hereinafter
referred to as "COUNTY").
WITNESSETH
WHEREAS, the existing City of Santa Clarita Enterprise Zone has contributed
substantially to the economic development and social advancement of portions of the Santa
Clarita Valley since 2007;
WHEREAS, the CITY and COUNTY applied for and were awarded an Enterprise Zone
designation by the State of California in the 2010 application round in order to extend Enterprise
Zone benefits to businesses in the City and unincorporated area of Los Angeles County;
WHEREAS, the implementation, management and marketing of an Enterprise Zone upon
designation is a long-term (15 -year) partnership between local governments, business
organizations and businesses;
WHEREAS, the successful implementation of an Enterprise Zone Program. requires a
strong commitment and cooperation by all of the program participants in support of job
development, job creation and economic development;
WHEREAS, the purpose of the California State Enterprise Zone Program is to stimulate
business and industrial growth in depressed areas of the state, help attract business to the state,
help retain and expand business and industry, and create increased job opportunities for all
Californians;
WHEREAS, the parties of this MOU have acknowledged that the Enterprise Zone
Program is needed within the territory of the two participating jurisdictions to improve economic
conditions and overall quality of life;
NOW, THEREFORE, the CITY and COUNTY agree as follows:

ARTICLE I DEFINITIONS
A. "Comprehensive Marketing Strategy" is a component of the Marketing Strategy and Plan
section of the Economic Development Plan included in the September 15, 2010, Santa Clarita
Valley Enterprise Zone Application.
B. "Department" is the California Department of Housing and Community Development.
C. "Economic Development Plan" is a part of the Zone including the "Marketing Strategy and
Plan," "Job Development Plan," "Vouchering Plan" and "Vouchering Fee Remittance Plan"
which can be found in the September 15, 2010, Santa Clarita Valley Enterprise Zone
Application.
D. "Marketing Strategy and Plan" is a part of the Economic Development Plan that details the
zone's marketing efforts for promoting the Enterprise Zone program.
E. "Job Development Plan" is the component of the Economic Development Plan that details the
zone's targeted employee screening, training, and job -linkage services.
F. "Vouchering Fee Remittance Plan" is the component of the Economic Development Plan that
details how voucher application fees are to be processed, managed and reported.
G. "Vouchering Plan" is the component of the Economic Development Plan that identifies the
process for verifying and determining the validity of claims, storage of documents and tracking
of categories of eligibility for vouchers.
H. "Zone" means the Santa Clarita Valley Enterprise Zone.
I. "Zone Manager" is designated by the City Manager of the City of Santa Clarita and is
responsible for administering the Zone.
J. "Zone Coordinator" is designated by the County of Los Angeles and is responsible for
working collaboratively with the Zone Manager to successfully implement the goals of the
Enterprise Zone program.
ARTICLE II ROLES OF PARTICIPATING AGENCIES
A. CITY OF SANTA CLARITA
1. The CITY, has prepared and approved a Letter of Commitment (Exhibit 1 to this
Memorandum) describing the resources being contributed to the implementation of the Zone
program.

2. The Zone Manager shall be designated by the City Manager. The Zone Manager shall be in
charge of the overall coordination of all programs and activities of the Zone. The Zone Manager
shall work with the Zone Coordinator of the COUNTY to ensure the successful implementation
of all of the components of the Enterprise Zone Economic Development Plan, periodically
review the achievement of the goals of the Zone, and verify compliance with the reporting
requirements to the State and all the members of the Zone.
3. The CITY and the COUNTY agree that the Marketing Strategy and Plan for the Zone shall be
implemented by the CITY with supporting implementation by the COUNTY and other economic
development partners.
4. The CITY agrees to continue to integrate the Zone program into existing and future programs.
5. The CITY and COUNTY agree that the Vouchering Plan and the Voucher Fee Remittance
Plan shall be implemented by the CITY. The CITY and COUNTY agree that the CITY shall be
the Vouchering Agent in charge of managing the issuance of vouchers to Enterprise Zone
program participants. The CITY shall accept.and process voucher applications and voucher fees.
The CITY shall be responsible for retention of voucher -related records for the life of the Zone
plus five years.
6. The Zone Manager, or his/her agent within the CITY, shall process and remit directly to the
Department by the 25'h day on the State's Monthly Form all of the $15.00 voucher application
fees collected on behalf of the Department during the preceding month.
7. The Zone Manager shall submit all reports to the Department. Copies of all reports submitted
by the Zone Manager to the Department shall be provided to the COUNTY's Zone Coordinator.
B. COUNTY OF LOS ANGELES
1. The COUNTY has prepared and approved a Letter of Commitment (Exhibit 2 to this
MOU) delineating the resources made available by the COUNTY for the implementation of the
Zone Program.
2. The COUNTY shall appoint an Enterprise Zone Coordinator who shall be the primary
point of contact for the unincorporated area of Los Angeles County. The COUNTY Zone
Coordinator shall be the main source for any required information relating to the Zone in the
unincorporated area that is requested by the Department.
3. The COUNTY, by and through the COUNTY Enterprise Zone Coordinator, may develop
its own local marketing programs designed to promote economic development and job creation
opportunities, focusing particularly on the unincorporated area of the County OF Los Angeles.
ARTICLE III ENTERPRISE ZONE PROGRAM FINANCING
A. The State of California (State) in granting the Zone designation does not provide funding for
the implementation of the Enterprise Zone program. Funding of the Enterprise Zone program
requires the commitment of all local participating jurisdictions for the duration of the enterprise
fund designation (15 years). The governing body of each participating agency has approved a
letter of commitment (Exhibits 1 and 2 to this MOU) detailing the resources being committed for
the marketing and operation of the Enterprise Zone program.
B. In addition to the staff and financial resources being made available by the participating
agencies, an additional funding source will be revenue generated from a surcharge to the $15.00
fee already required by the State for the issuance of vouchers. The CITY has adopted a $91.00
voucher application fee to be paid by employers. Of the $91.00 voucher application fee, $15.00
goes to the State and $76.00 is to recover costs to the CITY associated with administration of the
program, including job development and vouchering. This fee has been adopted and amended by
the CITY as permitted by State Law and Enterprise Zone Regulations. This fee will also be
adopted and amended by the COUNTY in accordance with State Law and Enterprise Zone
Regulations.
IN WITNESS WHEREOF, parties hereto have executed this MOU in Los Angeles County,

CALIFORNIA ENTERPRISE ZONE PROGRAM
AND THE
SANTA CLARITA VALLEY ENTERPRISE ZONE
An agreement establishing the Santa Clarita Valley Enterprise Zone pursuant to the
California Enterprise Zone Program.
1. PURPOSE OF AGREEMENT
This Memorandum of Understanding (hereinafter "Agreement") constitutes
official notification of the designation of the Santa Clarita Valley Enterprise Zone
(the "Contractor") under the California Enterprise Zone Program (the "Program")
administered by the State of California's Department of Housing and
Community Development.
The Program is authorized and governed by California Government Code
Section 7070, et seg. (the "Program Statutes") and the California Code of
Regulations, Title 25, Section 8430, et seg. (the "Program Regulations") all as
amended from time to time. In accepting this designation, the Contractor
agrees to comply with: (a) the Program Statutes; (b) the Program Regulations;
(c) the representations contained in the Contractor's Application made in
response to the Request For Proposal (the "Application"), which is hereby
incorporated into this Agreement; and (d) the terms and conditions of this
Agreement and its Supplement.
2. DEFINITION OF TERMS
Capitalized terms as used in this Agreement have the following definitions:
A. "Act" means the Enterprise Zone Act, as defined in Government Code
Section 7070.
B. "Department" means the State of California's Department of Housing and
Community Development (HCD) or its successor. HCD has legislative
authority and responsibility for the Enterprise Zone Program.
C. "Agreement" means this Memorandum of Understanding.
D. "Application" means the Santa Clarita Valley Enterprise Zone's Application
submitted to the Department.

E. "Audit" means any program performance audits of the Santa Clarita Valley
Enterprise Zone conducted by the Department, including an audit as
described in Government Code Section 7076.1.
F. "Contractor" means the Santa Clarita Valley Enterprise Zone obligated and
committed to providing goods and/or services, as referenced in the
Application.
G. "De -designation" or "De -designate," means the Department's action
_terminating this agreement, and/or rescinding the Enterprise Zone
designation in the event of non-performance as described in Government
Code Sections 7076.1 and 7076.2.
H. "Enterprise Zone" means the Santa Clarita Valley Enterprise Zone.
"Plan" means the Economic Development Plan prepared and adopted for the
Santa Clarita Valley Enterprise Zone and the California Enterprise Zone
designation.
"Program" means the State of California's State Enterprise and Economic
Development Section (SEEDS).
K. "Program Income" means income earned from the evaluation of forms and
supporting documentation submitted in application for a voucher, whether or
not such application is approved.
L. "Program Manager" means the primary contact as defined in the Application.
M. ""Voucher" or "Certificate" shall mean the certification described in subdivision
(c)(1) of Revenue and Taxation Code Sections 17053.74 and 23622.7 and
which contains all the information required by Section 8450.3 in a format
provided by the Department.
N. "Work" means the Enterprise Zone's program of activities contained within the
Plan for the Marketing, Job Development, Program Management, Financing,
Planning, Local Incentives and Vouchering of the Santa Clarita Valley
Enterprise Zone.
3. SCOPE OF WORK
A. Contractor shall perform the Work as described in the Application, which is
on file at the Department and which is incorporated herein by this reference.
All written materials or alterations submitted during the Enterprise Zone
designation period and which are approved in writing by the Program
Manager are included in the Work. In the event of a conflict between the
descriptions of the Work in the Application and as described in this
Agreement, the description in this Agreement shall prevail. The State

reserves the right to require the Contractor to modify any or all parts of this
Agreement in order to comply with the Program Statutes or Program
Regulations.
B. Contractor shall provide all necessary administrative activities in support of
the Santa Clarita Valley Enterprise Zone.
4. AGREEMENT PERIOD
This Agreement shall be in effect from January 1, 2011 through December 31,
2026, unless otherwise amended or terminated in writing by either party. After
June 30, 2011, the Department may Audit the Contractor to assure it has made
satisfactory and reasonable progress in implementing the obligations set forth in
the Application.
5. CITY AND DEPARTMENT PROGRAM COMMUNICATIONS
The contact for this Agreement will be the Enterprise Zone Manager. The
Enterprise Zone Manager, the primary contact, as stated in the Santa Clarita
Enterprise Zone Final Application, is Laura Biery at (661) 286-4017.
A. The State Enterprise and Economic Development Section's Representative

B. All official communications from the Program to the Enterprise Zone shall be

6. PROGRAM ADMINISTRATIVE BUDGET:

The Santa Clarita Valley Enterprise Zone's Operational Budget for Year One
provided under this Application shall be $120,000, not including costs of staff
time.
7. DEPARTMENT PROGRAM RESPONSIBILITIES:
The Department shall have the following responsibilities:
A. Inspections of Enterprise Zone Activity: Monitor, inspect and/or audit any
Santa Clarita Valley Enterprise Zone plans and activities performed hereunder
to ensure compliance with the Enterprise Zone's responsibilities as defined in
the Application, this Agreement and its Supplement, and applicable laws,
regulations, and guidelines, and to take corrective actions as provided by law.
B. Review and Approval of Plans, Agreements, and Products: Review and
approve Vouchering, Marketing, Incentive, Financing, Management and other
Plans, agreements, documents and products required by.the Application or by
law.
C. Assistance: Provide technical assistance, consultation, research and
analytical services to the Santa Clarita Valley Enterprise Zone, if requested, as
permitted by Program resources.

8. ENTERPRISE ZONE RESPONSIBILITIES:
The Enterprise Zone shall have the following responsibilities:
A. Performance: Generally, to make substantial and sustained efforts to
revitalize the Santa Clarita Valley Enterprise Zone areas through marketing,
incentives and financing programs, job development and independent
verification and issuance of vouchers. Specifically, to fulfill the terms,
conditions, and level of effort (staffing, budget, marketing, contracting) set
forth in this Agreement, including its Supplement, the Application and/or the
Plan, as may be supplemented or superseded by regulations, guidelines, and
other Program requirements during the designation period.
B. Performance Obligations - Third Party Relationships: Notwithstanding its
designation of any third party for the undertaking of all or any part of the
activities enumerated under this Agreement, the Santa Clarita Valley
Enterprise Zone shall remain fully obligated under the provisions of this
Agreement. The Santa Clarita Valley Enterprise Zone shall execute written
agreements with third parties identified in the Application, if any, and/or the
Plan for the performance of the Santa Clarita Valley Enterprise Zone's related
activities to ensure that .the activities being provided under this designation are
carried out in accordance with the Program requirements.

C. Enterprise Zone Manager: To hire and fund an Enterprise Zone Manager,
who shall be responsible for the Santa Clarita Valley Enterprise Zone's Plan,
vouchering, and implementation of this Agreement. The Santa Clarita Valley
Enterprise Zone Administrator will be responsible for the budget.
D. Enterprise Zone Budget/Maintenance of Effort: To establish, fund and
maintain the Enterprise Zone budget, under the direction of the Enterprise
Zone Administrator, to implement the Economic Development Plan and Scope
of Work. Without prior Department approval, the Enterprise Zone shall not
reduce the budget, staff allocation, or modify subcontracts to agencies or
community organizations identified in the Application as providing Santa
Clarita Valley Enterprise Zone services.
E. Vouchering:
1. Vouchering Administration - Contractor agrees to execute and maintain
the vouchering plan and vouchering procedures outlined in the Application.
The Vouchering Plan will assure that vouchers are properly issued in a timely
manner, adequately controlled and accounted for in the vouchering system.
Contractor is responsible for keeping records which fully disclose the
vouchering system. Procedures must provide for the accurate and timely
recordation of the receipt of the application fee, supporting documentation,
independent verification and approval or denial of the voucher. Adequate
documentation of each approved voucher application shall be maintained for
a minimum of five (5) years to permit the determination, through an audit if
requested by the State, of the accuracy of the records and the eligibility of
voucher applications. If the eligibility of a voucher cannot be determined
because supporting documentation is inadequate, the voucher shall be
disallowed.
2. Enterprise Zone Voucher — As of "Final" designation (01/01/11), the
Contractor or their agent shall begin accepting voucher applications and fees.
The Santa Clarita Valley Enterprise Zone must begin using the Department of
Housing and Community Development's Enterprise Zone Voucher form to
certify a business's participation with the Program.
3. Signatory Control - Unless the Department is notified otherwise in writing
by the Contractor, the Enterprise Zone Manager, as listed in Section 5, shall
have final signatory approval or denial of all voucher applications.
F. Voucher Application Fee:
1. Contractor agrees to establish a Voucher Application Fee ("Fee") and Bill
Remittance Form ("Form") and maintain fiscal control and accounting
procedures, which assures that the Fee received for the voucher application,
is properly disbursed, adequately controlled and accounted for in a Program
account. Contractor is responsible for keeping records, which fully disclose
the amount and disposition of the proceeds of the fees. The procedure

developed by Contractor must provide for the accurate and timely recordation
of the receipt of Fees, and unexpended balances. Adequate documentation
of each transaction shall be maintained to permit the determination, through
an audit if requested by the State, of the accuracy of the records. For each
voucher application accepted for processing, the Contractor shall disburse
$15.00 to the Department in accordance with the Program Regulations.
2. Any fees remaining at the end of the designation period or de -designation
date must be forwarded to the State. Checks must be made out to the
Department of Housing and Community Development and shall be mailed
within 180 days of the end of the designation period or de -designation date.
G. Public -Private Participation: The Enterprise Zone shall be the institutional
venue for the regular participation of public and private stakeholders in
decisions affecting the Enterprise Zone, its Plan, work programs and the
implementation of this Agreement.
H. Network Participation: Ensure that the Enterprise Zone Manager and
appropriate staff participate at meetings required by the Department, and at
conferences of the California Association of Enterprise Zones or similar
professional development organizations.
Performance Reporting: Contractor agrees to establish a data collection,
system and maintain data collection procedures, which assures that all data
are properly collected, adequately controlled and accounted for in the Annual
Survey as required by Government Code Section 7085(b). Contractor is
responsible for keeping records on all administrative and vouchering activities,
which fully disclose the effect of the Enterprise Zone on employment and
investment.
The Contractor is required to collect data for the Biennial Report that the
Department is required to provide biennially to the Legislature. Unless
specified otherwise in the Biennial Report, the Contractor will collect the data
and submit it to the Department at the address noted in Section 5 of this
Agreement.
The Biennial Report is to be completed by the Contractor pursuant to
Government Code Section 7085.1, The Enterprise Zone's performance
under this agreement will be based in part on whether it has submitted
complete reports on a timely basis.
The Contractor shall prepare and submit report(s) of the Enterprise Zone's
performance pursuant to a format, schedule and deadlines that the
Department requires. The Biennial Report will review Enterprise Zone's
progress toward its goals, objectives and commitments set forth in the original
application and Memorandum of Understanding with the Zone.

Audit: The Enterprise Zone shall maintain auditable voucher records at all
times. California Government Code Section 7076.1 requires the Department
to conduct an audit of each Enterprise Zone. The Department may schedule
annual Audits. The Enterprise Zone agrees that the Department and their
delegates have the right to receive, review, obtain, and copy all records
pertaining to the Enterprise Zone and/or its vouchering activities. The
Enterprise Zone further agrees to provide the Department or its delegates with
any relevant information requested and shall permit the Department or its
delegates access to its premises, upon reasonable notice, during normal
business hours for the purpose of interviewing employees and inspecting and
copying such books, records, accounts, and other material that may be
relevant to a matter under investigation for the purpose of determining
compliance with the designation, audit, or performance.
The.Enterprise Zone agrees to maintain all Enterprise Zone records,
including voucher applications, vouchers and supporting documentation for a
minimum of five (5) years after expiration of the Enterprise Zone designation.
If so directed by the Department upon termination of this agreement, or Re-
designation of the Enterprise Zone, the Enterprise Zone shall cause all
records, accounts, documentation and other materials related to the
Enterprise Zone activity to be delivered to the Department.
K. Conflict of Interest of Employees, or other Public Officials: No employee,
member of the governing body, or public official who exercise any functions or
responsibilities with respect to the program during his/her tenure or for one (1)
year thereafter, shall have any interest, direct or indirect, in any contract,
subcontract, or voucher, or the proceeds thereof, for activities performed in
connection with the Enterprise Zone, and all such persons shall comply with
Public Contracts Code Section10410 et seq., and Government Code Section
81000 et seq. (Political Reform Act of 1974), as applicable. Failure to comply
with this requirement may trigger an Audit.
9. AMENDMENT
No amendment or variation of the terms of this Agreement shall be valid unless
made in writing, and approved and signed by the parties to this Agreement. This
Agreement supersedes any oral promises, representations, or other agreements
with respect to the subject matter of this Agreement.
10. DISPUTES
The Department shall monitor the Enterprise Zone for performance and
compliance with this Agreement. Failure to meet the conditions of this Agreement
may be grounds for de -designation.

11. DE DESIGNATION OF THE ENTERPRISE ZONE
The Department may terminate this Agreement if the Enterprise Zone fails to
succeed in the Audit process as described in Government Code Sections 7076.1
and 7076.2. The Zone will have failed to demonstrate success in making
substantial and sustained efforts in meeting the goals and commitments as
presented in the Application. The effect of the notice specified in this section shall
be to terminate this Agreement and end Program designation of the Enterprise
Zone
12. APPROVAL
This Agreement, the Program's designation of the Enterprise Zone, as applicable,
is not valid until approved by the City of Santa Clarita and signed by all parties.

terms and conditions as set forth in this Agreement on the day, month and year
noted.

SANTA CLARITA VALLEY ENTERPRISE ZONE LETTER OF SUPPORT
We understand that the County of Los Angeles and the City of Santa Clarita have
partnered to expand the Enterprise Zone Designation in the Santa Clarita Valley
communities to stimulate economic growth. We concur that these areas are
economically challenged and we therefore support the application.
The Department of Public Works maintains an extensive network of streets and
highways consisting of over 230 miles of nonfreeway roadways, 164 traffic signals, over
4,700 traffic signs, and other appurtenant structures in the proposed zone.
Public Works also operates and maintains a complex system of flood control facilities
consisting of approximately 31 miles of storm drains/channels, 800 catch basins, and
other appurtenant structures in the zone. Our local sewer collection system in the zone
consists of approximately 94 miles of local sewerlines and 1,715 sewer manhole
structures.
In addition, over the next few years and subject to availability of funding, Public Works
intends to undertake an aggressive capital improvement program to our roadway
network within the zone (see enclosed project list).

• Assist the Enterprise Zone Manager with making Enterprise Zone information
available to the public by providing outreach programs, site visits, etc.;
• Provide assistance to the Enterprise Zone Manager to market the benefits of the
Santa Clarita Enterprise Zone to local and prospective businesses and
individuals;
• Further the one-stop permitting process;

The County of Los Angeles and the City of Santa Clarita have partnered to expand the existing Santa Clarita
Enterprise Zone in an area that we serve to stimulate economic growth throughout the Santa Clarita Valley.
I am the Planning Director of the Los Angeles County Department of Regional Planning and hereby pledge that we
will provide the utmost support to stimulate economic growth in the Santa Clarita Valley Enterprise Zone. The
Department of Regional Planning is the local land use planning agency for the unincorporated areas of Los Angeles
County. Our specific and quantifiable commitment is as follows:
• Assist the Enterprise Zone Manager with making EZ information available to the public;
• Expedite our one-stop permitting process for businesses located within the EZ;
• Assist in developing maps of the boundaries of the EZ;
• Coordinate code enforcementactivities within the EZ;
• Provide staff with appropriate time, authority and resources to fulfill the obligations of the EZ;
• Participate in the Project'Review Committee as needed to ensure that public safety issues for the EZ are
properly addressed;
• Ensure all permit applications submitted to the Department of Regional Planning are expedited;
• Attend training workshops provided by the Enterprise Zone Manager-,
• Work in partnership with the City of Santa Clarita and the County of Los Angeles to retain and expand
existing businesses;
• Disseminate EZ information to the public;
• Provide space for holding training meetings;
• Promote the EZ on the Department of Regional Planning website; and
• Refer interested individuals and businesses to the Enterprise Zone Manager, and inform the Manager of any
and all inquiries received regarding the Enterprise Zone.
In addition, DRP staff is in the process of updating the following long-range plans and policies in support of economic
development in the Santa Clarita Valley EZ area: '
1.. Planning and Iocal incentives
Density Bonus Program
The County's Density Bonus Program provides incentives for affordable housing by permitting density increases,
and requires set -asides for very low-, lower-, or moderate -income households and seniors. Density bonuses and
incentives consistent with the State Density Bonus law can be requested through an Administrative Housing
Permit. To qualify for a density bonus, the project must meet at least one of the following minimum requirements:
5% of the units set aside for very low-income households;
10% of the units set aside for lower-income households; 2

• 10% of the for -sale units set aside for moderate -income households;
• The donation of land for the development of housing for very low-income households;
• A senior citizen housing development consistent with State law; or
• A mobile home park for seniors consistent with State law.
With increases in the minimum set-aside, a project can receive a density bonus of up to 35% above what the
General Plan allows, based on a sliding scale.
In addition to an increase in density, the Density Bonus Program offers a variety of incentives. An applicant is
eligible for one or more incentives, depending on the amount of affordable units that have been set aside for very
low-, lower-, or moderate -income households. Incentives offered by the County include, but are not limited to:
• Reduced setbacks;
• Increased height limit;
• Reduced lot size requirements;
• Reduced lot width requirements;
• Reduced parking requirements;
• Additional density increases of up to 50% for 100% affordable developments for very low- and lower
income households; or
• Planning and zoning fee waivers for 100% affordable developments for very low- and lower-income
households.
Finally, the Density Bonus Program provides for waivers or modifications to development standards, requests for
incentives that do not meet the State criteria for qualified affordable housing developments, and up to a 50%
density bonus for senior citizen housing developments through a discretionary procedure (Discretionary Housing
Permit).
2. Land use plan for the application area., DRP is currently in the process of updating its General Plan. A number
of proposed key policy and program proposals will affect the application area:
Community -Based Planning Program: Several years ago, Los Angeles County and the City of Santa Clarita
initiated the One Valley One Vision (OVOV) effort. The objective of the OVOV effort is to update the
County's Santa Clarita Valley Area Plan and the City's General Plan with consistent goals, objectives, and
policies for the entire Santa Clarita Valley, which the two jurisdictions share. The County's updated Area
Plan is scheduled for adoption by the Board of Supervisors in 2011.
The County's updated Area PIan, developed through the OVOV effort, will support economic development in
the Santa Clarita Valley once it is adopted. The updated Area Plan includes Oolicies that promote the
continued development of regional employment centers (such as the Valencia Town Center and the Valencia
Commerce Center), the expansion of industries that provide job opportunities for local residents, and a
balanced ratio of jobs to housing, with a goal of at least 1.5 jobs per household. The updated Area Plan will
also designate additional land for a wide range of employment uses in a variety of settings, from shopping
centers and mixed-use developments to industrial parks and office towers.
• Industrial Land Use Policy: A recent study that was completed on the County's industrial land informed the
creation of General Plan policies to preserve and protect its remaining viable industrial land, as well as
policies to create additional opportunities for industrial and jobs -rich land to help the County's economic base
grow. The industrial land study, organizes the County's industrial land into two districts: Employment
Protection Districts and Flex Districts.

Employment Protection Districts: These areas represent economically viable industrial and employment -rich
lands, where industrial zoning and land use designations should remain, and where policies to protect
industrial land from other uses (residential and commercial) should be enforced. Industrial areas in Florence -
firestone, Willowbrook, and Rancho Dominguez are all designated Employment Protection Districts.
Flex Districts: These are areas that are designated industrial, but require further study due to existing and
surrounding uses. Flex districts could allow for the development of non -industrial uses and mixed uses, where
appropriate, but also allow light industrial or office/professional uses that are compatible with residential uses.
Identified flex districts in the General Plan serve as a framework for future considerations in Community -
Based Planning initiatives.
• Economic Development Element: The Economic Development EIement outlines the County's economic
development goals, addresses the role of the County unincorporated areas in the regional economy, and
provides strategies that contribute to the financial well-being of the County. The element. also provides
strategies, policies and implementation actions for the redevelopment and revitalization of unincorporated
communities. Several programs in the Implementation Program speak toward redevelopment and
revitalization efforts in unincorporated communities including Florence -Firestone, Willowbrook, and Rancho
Dominguez. These include:
Redevelopment and Revitalization Expansion: Expand and renew the County's Redevelopment areas and
other incentive zones and districts to better address the need for economic development throughout the
County's industrial and commercial areas, and to revitalize economically disadvantaged neighborhoods by
incentivizing services and employment opportunities.
GIS Economic Development website: Create a website and related materials that guide developers and the
business community through the County planning and permitting process, including information on policies
that facilitate infill development and smart growth, and a regularly updated site inventory of public land that
is available for economic investment and redevelopment opportunities.
• Other Feasibility Studies: The following programs were included as programs in the Los Angeles County
Housing Element as feasibility studies.
Inclusionary Housing Program. Also known as inclusionary zoning, inclusionary housing is a Iocal policy
that can help local jurisdicitons meet their affordable housing goals. The study will focus on analyzing the
feasibility of requiring an affordable housing fee; requiring affordable housing set -asides for for -sale projects;
and requiring affordable housing set -asides when applicants enter into an agreement to provide affordable
units in exchange for financial assistance, incentives or as part of a development agreement. It is anticipated
that the feasibility study will be going to the Board of Supervisors in December, 2010.
Small Lot Subdivision. The purpose of this study is to determine whether or not it is feasible for the County of
Los Angeles to establish a program for small lot subdivisions. As used in this study,.a "small lot subdivision"
is defined as a land division which creates lots having an area of less than 5,000 square feet; these small lots
are generally less than 50 feet wide. The small lot subdivisions are intended for detached single-family
residences.
By allowing greater flexibility in lot sizes and widths, the small lot subdivisions represent one of the tools that
the County can use to promote the construction of affordable housing. Reducing the amount of land required
for new residences can potentially result in a significant reduction in the price of a new house because of the
high cost of land in the County. Lower home prices would allow more residents to own their own home and

increase neighborhood stability. The small lot subdivision technique could also result in an increase in the
number of single-family homes built in the County and ease overcrowding by allowing a greater variety in lot
sizes.
The Board of Supervisors instructed the Department of Regional Planning to conduct a small lot subdivision
feasibility study in its action on August 5, 2008 when it -adopted the Housing Element of the General Plan.
The Department submitted the feasibility study to the Board on October 1, 2009. The study found that it
is feasible to establish a program for small lot subdivision.
Graduated Density Zoning. The urbanized unincorporated areas are characterized by small parcels that are
often developed at densities lower than permitted by zoning. Fragmented ownership makes the assemblage of
parcels for large-scale developments such as mixed use and transit oriented development difficult, if not
financially infeasible. A tool to incentivize lot consolidation is "graduated density zoning." This tool offers
increased density based on the size of the site, thereby encouraging owners of adjoining properties to
collaborate in development or to package parcels for sale.
3. Neighborhood transformation activities. DRP is currently involved in the following neighborhood
transformation activities: '
Nuisance Abatement Teams: The Santa Clarita Valley and Acton/Canyon Country Nuisance Abatement
Teams (NATs) are task forces consisting of code enforcement staff from the County's Departments of Public
Works (Property Rehabilitation, Code Enforcement, and Environmental Programs (on an as needed basis)),
Regional Planning (Zoning Enforcement), and Public Health. The NATs address residential and
commercial/industrial properties with violations from multiple County agencies with some of the most
egregious, long-standing problems in the community.

SUBJECT: LETTER OF COMMITMENT TO THE SANTA CLARITA VALLEY
ENTERPRISE ZONE
Dear Mr. Nunn,
The Community Development Commission of the County of Los Angeles (Commission)
is partnering with the City of Santa Clarita to pursue an Enterprise Zone designation
within the Santa Clarita Valley. The following is a list of specific commitments that the
County, through the Commission, will make to stimulate economic growth in the
proposed Enterprise Zone:
Enterprise Zone Administration
• Ensure coordinated efforts between City of Santa Clarita staff and all Los
Angeles County Departments;
• Develop Santa Clarita Valley Enterprise Zone materials, such as brochures,
maps of the Enterprise Zone, and other materials as necessary;
• Refer interested individuals and businesses to the Enterprise Zone Manager, and
inform the Manager of any and all inquiries received regarding the Enterprise
Zone; and
• Provide Enterprise Zone administration staff with appropriate time, authority and
resources to fulfill the obligations of the Enterprise Zone,

• Assist the Enterprise Zone Manager with the development and distribution of
Santa Clarita Valley Enterprise Zone marketing material;
• Assist the Enterprise Zone Manager with site visits, outreach programs, and

• Market the benefits of the Enterprise Zone program to local and prospective

• Attend Enterprise Zone training workshops facilitated by the Enterprise Zone
Manager; and
• Promote the Santa Clarita Valley Enterprise Zone on the Commission website
(www.lacdc.orq).
Enterprise Zone Economic Development
• Provide access to capital at a time when lending is tight by marketing the
Commission's loan programs directly to businesses in the area; and
• Work in partnership with Los Angeles Economic Development Corporation, the
City of Santa Clarita, the Santa Clarita Economic Development Corporation, and
other partnerships as necessary to retain, expand, and attract businesses to the
Santa Clarita Valley.

The Los Angeles County Department of, Public Social Services (DPSS) is aware of Santa Clarita
Valley's intent to apply for and receive the designation as a California Enterprise Zone. This
designation would allow tax and financial incentives to businesses located within the boundaries
of the enterprise zone. It would also encourage business investment and the creation of new jobs
within the Santa Clarita Valley.
DPSS recognizes the importance of the Enterprise Zone Program. This Program gives employers
an incentive to hire individuals who are motivated to find jobs, but face certain barriers to
employment. It also encourages business growth by creafing jobs and keeping individuals
employed within their own communities. We acknowledge the significance of this application, as
this helps create a win-win situation for businesses and disadvantaged individuals seeking
employment. The employment opportunities created by this designation for our Greater Avenue
for Independence (GAIN) Welfare -to -Work participants will assist them in achieving self-
sufficiency.
