Gorman DATE: April 24, 2012 SUBJECT: DECLARING RESULTS OF APRIL 10, 2012 GENERAL MUNICIPAL ELECTION DEPARTMENT: City Manager's Office RECOMMENDED ACTION City Council adopt a resolution reciting the fact of the General Municipal Election held on April 10, 2012, declaring the result and such other matters as provided by law. BACKGROUND By Resolution No. 11-82 , adopted on November 8, 2011, the City Council called and gave notice of the holding of a general municipal election on April 10, 2012, for the election of certain officers as required by the provisions relating to general law cities. As specified in Elections Code Sections 10263 and 10264, upon completion of the canvass, the Elections Official (City Clerk) shall certify the results to the governing body (City Council). The City Council shall meet at its usual place of meeting, no later than the third Friday after the election, to declare the results and to install the newly elected officers. The City Council shall declare elected the persons for whom the highest number of votes were cast for each office. Upon completion of the canvass and before installing the new officers, the Council shall adopt a resolution reciting the fact that the General Municipal Election of April 10, 2012, was conducted as required by law; notice of election was given in time, form, and manner as provided by law; voting precincts were properly established; election officers were appointed, and that in all respects the election was held and conducted and the votes were cast, received, and canvassed and the returns made and declared in the time, form, and manner as required by the provisions of the Elections Code of the State of California. The City Clerk has completed all necessary steps in order to properly and lawfully conduct this l election. A resolution reciting the facts of the election has been prepared for Council consideration and includes the City Clerk's Certificate of Canvass. After adoption of the resolution, the City Clerk will swear in the newly elected members of the City Council. ALTERNATIVE ACTIONS No other actions have been determined. FISCAL IMPACT Adequate funds have been appropriated as part of the FY 2011/2012 budget process to conduct this election. ATTACHMENTS Resolution LWN RESOLUTION NO. 12- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON TUESDAY, APRIL 10, 2012, DECLARING THE RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS, a General Municipal Election was held and conducted in the City of Santa Clarita, California on Tuesday, April 10, 2012, as required by law; and WHEREAS, notice of the election was given in time, form, and manner as provided by law; voting precincts were properly established; election officers were appointed, and in all respects the election was held and conducted and the votes were cast, received, and canvassed and the returns made and declared in time, form, and manner as required by the provisions of the Elections, Code of the State of California for the holding of elections in general law cities; and WHEREAS, the City Clerk canvassed the returns of the election and has certified the results to this City Council, the results are received, attached, and made a part hereof as "Exhibit A." NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA DOES HEREBY RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOWS: Section 1. That the whole number of votes cast in the City except mail -in voter ballots and provisional ballots was 3,783. That the whole number of absent voter and provisional ballots cast in the City was 11,607 making a total of 15,390 votes cast in the City. Section 2. That the names of the persons voted for at the election for members of the City Council were as follows: Ed Colley, Bob Kellar, Jon Hatami, Laurie Ender, and TimBen Boydston. Section 3. That the number of votes given at each precinct and the number of votes given in the City to each of the persons above named for the respective offices for which the persons were candidates were as listed in Exhibit "A" attached. Section 4. The City Council does declare and determine that Bob Kellar was elected as member of the City Council for the full term of four years; and TimBen Boydston was elected as member of the City Council for the full term of four years. Section 5. The City Clerk shall enter on the records of the City Council of the City, a statement of the result of the election, showing: 1) the whole number of votes cast in the 7 City, 2) the names of the persons voted for, 3) for what office each person was voted for, 4) the number of votes given at each precinct to each person, and 5) the total number of votes given to each person. Section 6. That the City Clerk shall immediately make and deliver to each of the persons so elected _ a Certificate of Election signed by the City Clerk and authenticated; that the City Clerk shall also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected. Section 7. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions. PASSED, APPROVED AND ADOPTED this 24th day of April, 2012. Gorman, City Clerk of the City of Santa Clarita, do certify that I have canvassed the returns of the General Municipal Election held on April 10, 2012, and find that the number of votes given at each precinct and the number of votes given in the City to persons voted for, the respective offices for which the persons were candidates, were as follows: FOR MEMBERS OF THE CITY COUNCIL (See attached spreadsheet listed by precinct number for ballots voted at precinct; and ballots returned by mail with provisional ballots, showing the total number votes cast for each candidate.) There were no discrepancies between the machine count and the manual count of the in person precinct voted ballots. The discrepancies between the machine count and the manual tally of the Vote By Mail ballots were not statistically significant and are as follows: Precinct 56, Vote By Mail: Colley - 1 additional Kellar - 2 additional Hatami - 1 less Ender - 1 additional Boydston - 1 additional Precinct 64, Vote by Mail: Kellar - 1 additional Hatami - 1 less Boydston - 1 additional It has been determined that the statistically insignificant difference in the machine count and the manual count is due to the possible sticking together of a ballot card on the machine counter and insufficient duplication of ballot cards.
