CA -95-X137, CA -96-X071, AND CA -04-0246 - APPROVE PLANS AND SPECIFICATIONS AND AWARD CONSTRUCTION CONTRACT DEPARTMENT: Public Works RECOMMENDED ACTION City Council: Approve the plans and specifications for the McBean Regional Transit Center Park -and -Ride, Project T1012, Federal Transit Administration, American Recovery and Reinvestment Act (ARRA), Funding Project Nos. CA -95-X137, CA -96-X071, and CA -04-246. 2. Award the construction contract to TOBO Construction, Inc., in the amount of $3,630,000, and authorize a contingency in the amount of $620,000 for a total contract amount not to exceed $4,250,000. 3. Authorize an increased expenditure in the amount of $181,000 to the existing professional services contract with Tetra Tech, Inc., for construction engineering support, including construction survey staking, quality assurance construction material testing, and structural welding inspection services. 4. Appropriate funds in the amount of $912,428 to expenditure account T1012700-5161.001 and $36,608 to expenditure account T1012261-5161.001. Increase the Federal ARRA revenue account 700-4424.012 by $156,451, Federal 5307 revenue account 700-4424.009 by $361,715, and Municipal Operators Service Improvement Program revenue account 700-4422.007 by $394,262. 5. Decrease revenues and expenditures by $300,000 in accounts 229-4424.009 and T1012229-5161.001, and increase revenues and expenditures by $300,000 in accounts 700-4424.009 and T1012700-5161.001. 6. Decrease expenditure account T1012261-5161.001 (Proposition A Local Return) by $200,000, and increase expenditure account T1012232-5161.001 (Air Quality Management District Fund) by $200,000. 7. Authorize the City Manager or designee to execute all contracts and associated documents, or modify the awards in the event issues of impossibility of performance arise, contingent upon the appropriation of funds by the City Council in the annual budget for such fiscal year, and execute all documents subject to City Attorney approval. 7T60Sf0108L1ir In November 2006, the City Council adopted the 2006-2015 Transit Development Plan, which identified the proposed site for a future park-and-ride facility. Subsequently, the City Council approved a grant application to the Los Angeles County Metropolitan Transportation Authority (Metro) for the Congestion Mitigation Air Quality (CMAQ) Fund in January 2007. The City has received a total of $4.7 million in federal and local funds through the American Recovery and Reinvestment Act and CMAQ Fund from the Federal Transit Authority and Metro, respectively. These funds are site specific for the preparation of environmental documents, design, construction, and construction engineering support for the park-and-ride facility and may not be used for any other purpose. Staff conducted two public outreach meetings for the project. The meeting invitations were mailed to residents within a 1,000 -foot radius of the project limits, and press releases were issued inviting the general public, including transit riders. Staff also met separately with local homeowners and homeowners associations from the Woodlands and Valencia North Valley at their request to offer feedback on the concept plan and preliminary design plan. From these meetings, staff incorporated in the project a photocell -controlled lighting system, site fencing, and landscaping with matured trees to minimize visual impacts. On October 18, 2011, the Planning Commission approved a Conditional Use Permit (11-011), including Mitigated Negative Declaration for California Environmental Quality Act and an Oak Tree Permit (11-024) for the project. The land acquisition was approved at the City Council meeting on November 8, 2011. The Oak Tree Permit is required to remove three non -heritage oak trees currently on the property, but the proposed project will plant five 60 -inch box -size and seventeen 48 -inch box -size oak trees. The project site is adjacent to the McBean Regional Transit Center on Valencia Boulevard, west of McBean Parkway (see attached location map). The project will increase access to the local and regional transit routes and address public transportation parking capacity issues. This new facility is an ideal location to serve commuters and rideshare passengers, nearby residential neighborhoods, employment and retail centers, municipal facilities, and the local community college. 2 The key components of this project include a maximum of 282 parking spaces, five additional bus bay concrete platforms covered by steel canopies for commuter buses, landscape enhancements, low -impact site lighting, public art installations, transit operation service features, and closed circuit television security system. Additionally, the scope of work includes low -impact development elements, such as bio-swales, bio -retention basins, and permeable concrete pavement. An invitation to bid was published three times: July 29, August 7, and August 11, 2012, and was noticed on the City's website. Plans and specifications were also sent to area plan rooms. Sixteen bids were submitted to the City and opened by Purchasing on October 11, 2012. The results of the bids are shown below: Company Location Bid Amount TOBO Construction, Inc. (TOBO), in the amount of $3,630,000. Staff recommends the project be awarded to TOBO for the bid amount, plus a contingency of $620,000, for a total contract amount not to exceed $4,250,000. The contractor possesses a valid State contractor's license and is in good standing with the Contractors State License Board. The contractor's bid was reviewed for accuracy and conformance to the contract documents and found to be complete. While the City maintains a "Support of Local Businesses" policy that can be utilized by the City Council when warranted, the City is governed by the State Public Contract Code with regard to public works project procurement. In these types of procurement, the Public Contract Code does not permit a City to utilize a "Support of Local Businesses" policy and instead requires the contract be awarded to the "lowest responsible bidder." As confirmed by the City Attorney's Office, this direction precludes the City from applying any superseding criteria for award, except in the case of a tie. Thus, in the awarding of Public Works contracts, the City is not permitted to award to a bidder just because they are local, as the State Public Contract Code does not allow the City to recognize them as the "lowest" responsible bidder. 3 The construction contingency amount requested will cover the cost of unforeseen site conditions, such as removal of unsuitable soil and utility work. The actual volume of unsuitable soil will be determined during construction and abandoned utilities may be discovered. Staff also recommends increasing the spending authority in the amount of $181,000 to the existing professional services contract with Tetra Tech, Inc., for construction engineering support. The spending authority amount will also include the services for construction survey staking, quality assurance construction material testing, and structural welding inspection services by Pinnacle Land Surveying, Inc., and R.T. Frankian & Associates, respectively. Both R.T. Frankian & Associates and Pinnacle Land Surveying, Inc., were involved in developing plans and specifications. ALTERNATIVE ACTIONS Other action as determined by the City Council. FISCAL IMPACT There is currently $3,974,284 budgeted for this project, of which $152,320 has been expended or encumbered. The request for increased appropriations totaling $949,036 is a combination of existing available grant funds and additional funding. The requested appropriations will increase the budget to $4,923,320, of which $4,771,000 is available for construction. The requested appropriations will adequately provide for all anticipated expenses for construction administration costs, including staff time for construction/project management, inspection services, labor compliance services, environmental monitoring, miscellaneous project administration costs of $210,000, anticipated water connection fees in the amount of $100,000 to Castaic Lake Water Agency, and placement of two public art exhibits estimated to cost $30,000.
