City Council approve the plans and specifications for the 2011-12 Overlay and Slurry Seal Program, Project M0084. Award the construction contract to All American Asphalt in the amount of $5,995,000, and authorize a contingency in the amount of $599,500, for a total contract amount not to exceed $6,594,500. 3. Award professional services contract to Pavement Engineering, Inc., in the amount of $65,000, for pavement inspections and updates for the Pavement Management System. 4. Award professional services contract to BTC Labs -Vertical Five in the amount of $372,000 for project inspection and materials testing. 5. Authorize an expenditure increase not to exceed $50,000, to the existing professional services contract with Pavement Engineering, Inc., for design and construction support services. 6. Authorize the transfer of $365,000 from the 2010-11 Federal Overlay Program Account M0083233-5161.001 to the 2011-12 Overlay and Slurry Seal Program Account M0084233-5161.001. Increase Expenditure Account M0077233-5161.001 by $212,000 and decrease Expenditure Account M0077230-5161.001 by $212,000. 8. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval. nn ir�y`�I1�tJzr,�3f i Lt�li UJJ LU BACKGROUND The Annual Overlay and Slurry Seal Program project is an integral part of the City's pavement management program. Each year, streets are evaluated and identified for their need of rehabilitation or maintenance treatments. The 2011-12 project will provide asphalt overlay and slurry seal treatments in various areas of the City (see attached project streets list). These treatments will provide a smoother ride for traffic and enhance the appearance of the roadway and surrounding area. This year's project is scheduled to begin construction in July and be completed by the end of November 2012. An invitation to bid was published three times (April 25, April 29, and May 2, 2012) and posted to the City's website. Plans and specifications were also sent to area plan rooms. Seven bids were submitted to the City and opened by Purchasing on May 21, 2012. The results of the bids are shown below: Company All American Asphalt Toro Enterprises, Inc. The City reserves the right to award the base bid and any of the alternates at the City's discretion. The bid results shown above include all of the Additive Alternates (1 through 8). Staff recommends awarding the base bid and additive alternates 1 through 8. Upon review of the bids, staff recommends awarding the construction contract to the lowest responsive bidder, All American Asphalt, which possesses a state contractor's license and is in good standing with the Contractors State License Board. The bid from All American Asphalt was reviewed for accuracy and conformance to the contract documents and found to be complete. To ensure efficient and proper procedures in construction and materials testing, costs for construction inspection and materials testing services were anticipated and identified in the original budget. A request for proposal was sent to several consultants. Upon reviewing the consultants' proposals, staff recommends awarding the construction management and materials testing services contract to BTC Labs -Vertical Five in an amount not to exceed $372,000. BTC Labs -Vertical Five has worked well with the City on past projects and has demonstrated competent and timely services. While the City maintains a "Support of Local Businesses" policy that can be utilized by the City Council when warranted, the City is governed by the State Public Contract Code with regard to public works project procurement. In these types of procurements, the State Public Contract Code does not permit a city to utilize a "Support of Local Businesses" policy and instead requires G the contract be awarded to the "lowest responsible bidder." As confirmed by the City Attorney's Office, this direction precludes the City from applying any superseding criteria for award except in the case of a tie. Thus, in awarding public works contracts, the City is not permitted to award to the second lowest bidder just because they are local, as the State Public Contract Code does not allow the City to recognize them as the "lowest responsible bidder." Last year's paving project, 2010-11 Federal Overlay Program, Project M0083, has $365,000 in savings that is recommended to be transferred to this year's project. Also, staff is seeking authorization of an expenditure increase not to exceed $50,000, for design services to the existing professional services contract with Pavement Engineering, Inc., for design and construction support services. Additionally, staff is recommending a funding swap of $212,000 in Gas Tax Funds currently budgeted in the 2010-11 Overlay and Slurry Seal Program, Project M0077, with Transportation Development Act Article 8 Funds in the amount of $212,000, to maximize the use of available Transportation Development Act funding. As part of the annual street maintenance project, the City also inspects and records pavement conditions citywide. Staff is seeking authorization of $65,000 for Pavement Engineering, Inc., for pavement inspections and updates to the City's Pavement Management System. The City is responsible for the maintenance of 999 lane miles. Adequate funds have been appropriated for construction management, survey, labor compliance, staff oversight, and project administration costs, as well as a future federally funded overlay project. ALTERNATIVE ACTIONS Other action as determined by the City Council. FISCAL IMPACT The budget for the 2011-12 Overlay and Slurry Seal Program, Project M0084, is $7,750,000. The recommended actions will make available a budget of $8,115,000 for the 2011-12 Overlay and Slurry Seal Program to adequately provide for all anticipated construction and project management costs, and for a future federally funded overlay program, the 2011-12 Federal Overlay Program.
