HomeMy WebLinkAbout2012-08-28 - AGENDA REPORTS - TAX EXCHANGE NORTH COPPERHILL (2)CONSENT CALENDAR DATE: SUBJECT: DEPARTMENT: Agenda Item: 15 CITY OF SANTA CLARITA AGENDA REPORT City Manager Approval: Item to be presented by: August 28, 2012 JOINT RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, AND THE GOVERNING BODIES OF THE GREATER LOS ANGELES COUNTY VECTOR CONTROL DISTRICT, SANTA CLARITA VALLEY SANITATION DISTRICT OF LOS ANGELES COUNTY, CASTAIC LAKE WATER AGENCY, AND NEWHALL COUNTY WATER DISTRICT, APPROVING AND ACCEPTING THE NEGOTIATED EXCHANGE OF PROPERTY TAX REVENUE RESULTING FROM "GREATER LOS ANGELES COUNTY VECTOR CONTROL DISTRICT ANNEXATION NO. 2011-22" TO THE GREATER LOS ANGELES COUNTY VECTOR CONTROL DISTRICT Administrative Services RECOMMENDED ACTION City Council adopt the Joint Resolution of Negotiated Exchange of Property Tax Revenue for the North Copperhill annexation area to the Greater Los Angeles County Vector Control District. BACKGROUND On August 23, 2011, the City Council adopted Resolution No. 11-22, initiating annexation proceedings for the North Copperhill Annexation area with the Local Agency Formation Commission (LAFCO). On October 25, 2011, the application was submitted to LAFCO. LAFCO DIRECTION At the June 26, 2012 City Council Meeting, the City Council approved the resolution for the negotiated property tax revenue for the North Copperhill annexation area and further included a Property Transfer Agreement for the transfer of three parks within the annexation area to the City. At the direction of LAFCO, a Tax Transfer Resolution has been prepared to include annexation of the applicable portions of the North Copperhill annexation area to the Greater Los Angeles County Vector Control District. NEXT STEPS Upon approval of the joint resolution by the City Council, the Los Angeles County Board of Supervisors, along with the Governing Bodies of the Greater Los Angeles County Vector Control District, Santa Clarita Valley Sanitation District of Los Angeles County, Castaic Lake Water Agency, and Newhall County Water District, will schedule the applicable hearings necessary to sign and accept the joint resolution. Subsequent final steps include as many as two LAFCO hearings for the annexation. LAFCO initially scheduled the first hearing for their August 8, 2012 meeting. The item was continued to their October 12, 2012 meeting for the first general public hearing on the item. LAFCO will hold a "protest hearing" on the annexation within 30 days of their initial public hearing and can certify the annexation, assuming there is no opposition. This process is anticipated to be completed in mid to late November. The proposed joint resolution provides for a transfer of property tax revenue to the Greater Los Angeles County Vector Control District as calculated by the Auditor -Controller of Los Angeles County, beginning the year after filing of the statement of boundary change for the North Copperhill Annexation Area. ALTERNATIVE ACTIONS 1. Direct staff to terminate annexation proceedings. 2. Direct other actions as determined by the City Council. FISCAL IMPACT The service expenditures related to this annexation are offset by the revenue to be collected from within the annexation area. This annexation is fiscally neutral and will not have a negative fiscal impact on the City of Santa Clarita. ZC |&55: §Q � q JOINT RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, AND THE GOVERNING BODIES OF THE GREATER LOS ANGELES COUNTY VECTOR CONTROL DISTRICT, SANTA CLARITA VALLEY SANITATION DISTRICT OF LOS ANGELES COUNTY, CASTAIC LAKE WATER AGENCY, AND NEWHALL COUNTY WATER DISTRICT, APPROVING AND ACCEPTING THE NEGOTIATED EXCHANGE OF PROPERTY TAX REVENUE RESULTING FROM "GREATER LOS ANGELES COUNTY VECTOR CONTROL DISTRICT ANNEXATION NO. 2011-22" TO THE GREATER LOS ANGELES COUNTY VECTOR CONTROL DISTRICT WHEREAS, pursuant to Section 99 of the Revenue and Taxation Code, for specified jurisdictional changes, the governing bodies of affected agencies shall negotiate and determine the amount of property tax revenue to be exchanged between the affected agencies; and WHEREAS, the Board of Supervisors of the County of Los Angeles, as the governing body of the County, Consolidated Fire Protection District, Road District No. 5, and Flood Control District, and the governing bodies of the Greater Los Angeles County Vector Control District; Santa Clarita Valley Sanitation District of Los Angeles County; City of Santa Clarita; Castaic Lake Water Agency; and Newhall County Water District have determined the amount of property tax revenue to be exchanged between their respective agencies as a result of the "Greater Los Angeles County Vector Control District Annexation No. 2011-22" is as set forth below: NOW, THEREFORE, BE IT RESOLVED as follows: 1. The negotiated exchange of property tax revenue between the County of Los Angeles, Greater Los Angeles County Vector Control District, Santa Clarita Valley Sanitation District of Los Angeles County, City of Santa Clarita, Castaic Lake Water Agency, and Newhall County Water District resulting from Annexation No. 2011-22 is approved and accepted. 2. For the fiscal year commencing in the year after the filing of the statement of boundary change for Annexation No. 2011-22 with the Board of Equalization pursuant to Government Code sections 54902 and 57204, and every fiscal year thereafter, the following ratios of the annual property tax growth for the following Tax Rate Areas (TRAs) shall be transferred to the Greater Los Angeles County Vector Control District as a result of Annexation No. 2011-22 to the District. The other taxing entities share of property taxes in the affected TRAs shall be adjusted as calculated by the Auditor -Controller of Los Angeles County.
