HomeMy WebLinkAbout2013-04-09 - AGENDA REPORTS - MC 12-132 HABITAT FOR HEROES (2)CONSENT CALENDAR DATE: SUBJECT: DEPARTMENT: CITY OF SANTA CLARIT, AGENDA REPORT City Manager Approval: Item to be presented by: April 9, 2013 Agenda Item: 5 MASTER CASE 12-132: HABITAT FOR HEROES Community Development RECOMMENDED ACTION City Council conduct a second reading and adopt an Ordinance entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA APPROVING ZONE CHANGE 12-001 (MASTER CASE 12-132), TO AMEND THE ZONING MAP AND CHANGE THE ZONING OF ASSESSOR'S PARCEL NUMBER 2836-015-029 FROM BUSINESS PARK (BP) TO RESIDENTIAL MODERATE (RM) ON THE PROJECT SITE LOCATED JUST SOUTH OF THE INTERSECTION OF CENTRE POINTE PARKWAY AND GOLDEN TRIANGLE ROAD, IN THE CITY OF SANTA CLARITA." BACKGROUND On March 26, 2013, the City Council adopted a resolution approving Master Case 12-132 and all associated entitlements. The approved project includes 87 affordable housing units for veterans of the United States military and their families. The project is located at Assessor's Parcel Number 2836-015-029. The City Council directed staff to include additional conditions of approval regarding planting of mature landscaping, and future tree planting and trail construction improvements on the approximately 13 acres of undisturbed land on the subject property. All landscaping planted on-site will be consistent with the City's required landscape palette of native plants which will serve to enhance the habitat of local wildlife species. The City Council also introduced and passed an Ordinance for a zone change of the subject property to a second reading on April 9, 2013. The proposed zone change would alter the City of Santa Clarita's zoning map by changing the zone of the subject property from Business Park (BP) to Residential Moderate (RM). Exhibit A: Zone Change ORDINANCE 13 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA APPROVING ZONE CHANGE 12-001 (MASTER CASE 12-132), TO AMEND THE ZONING MAP AND CHANGE THE ZONING OF ASSESSOR'S PARCEL NUMBER 2836-015-029 FROM BUSINESS PARK (BP) TO RESIDENTIAL MODERATE (RM) ON THE PROJECT SITE LOCATED JUST SOUTH OF THE INTERSECTION OF CENTRE POINTE PARKWAY AND GOLDEN TRIANGLE ROAD, IN THE CITY OF SANTA CLARITA. THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. FINDINGS OF FACT. The City Council does hereby make the following findings of fact: a. On September 21, 2012, Habitat for Humanity (the applicant) filed an application (Master Case 12-132) for the construction of a 87 affordable housing units located at assessor's parcel number 2836-015-029, just south of the intersection of Centre Point Parkway and Golden Triangle Road in the City of Santa Clarita; b. Zone Change 12-001 will change the zoning designation of APN 2836-015-029 from Business Park (BP) to Residential Moderate (RM). The zoning will be consistent with the proposed General Plan classification; c. A Mitigated Negative Declaration for Master Case 12-132 has been prepared and circulated in compliance with the California Environmental Quality Act (CEQA); d. On February 19, 2013, the Planning Commission held a duly noticed public hearing on Master Case 12-132. The Planning Commission voted 5-0 recommending that the City Council adopt the Mitigated Negative Declaration and that the City Council approve the Entitlements, per Resolution No. P13-001; e. On March 26, 2013, the City Council held a duly noticed public hearing on this issue, commencing at 6:00 p.m. at City Hall, located at 23920 Valencia Boulevard, City of Santa Clarita; f On March 26, 2013, the City Council adopted a Mitigated Negative Declaration and approved Master Case 12-32 with the associated entitlements for the development of an 87 -unit affordable housing project. The Council approved, and passed the ordinance to a second reading on April 9, 2013; g. All public hearings and meetings on Master Case 12-132 held by the Planning Commission were at 7:00 p.m. in the City Council Chambers, located at 23920 Valencia Boulevard, City of Santa Clarita. All public hearings and meetings held by the City Council were at 6:00 p.m. in the City Council Chambers, located at 23920 Valencia Boulevard, City of Santa Clarita. All public hearings were advertised in The Signal newspaper and by direct first-class mail to property owners within 1,000 feet of the subject property. In addition, the date and time of the public hearings were posted on the subject site; and h. The documents and other materials, which constitute the record of proceedings upon which the decision of the City Council is based, are on file within the Community Development Department and arc in the custody of the Director of Community Development. SECTION 2. FINDINGS FOR A ZONE CHANGE. Based on the above findings of fact and recitals and the entire record, including, without limitation, the Mitigated Negative Declaration prepared for Master Case 08-194, oral and written testimony and other evidence received at the public hearings held on the project, reports and other transmittals from City staff to the City Council, and upon studies and investigations made by the Planning Commission and on its behalf, the City Council finds, as follows: a. The proposed zone change is consistent with the objectives of the City's Unified Development Code, the City's General Plan, and the development policies of the City of Santa Clarita. Following approval of Zone Change 12-001 amending the City's Zoning Map, Master Case 12-132 is consistent with the designation of Residential Moderate (RM). The RM zone allows for a density -maximum of I I units per gross acre. However, given the average cross slope of the subject property the maximum number of units is 88. The proposal calls for 87 units is within the threshold. Further, the proposed project complies with all of the standards and requirements for residential development as defined by the Unified Development Code (UDC) Section 17.15.020. SECTION 3. Based on the consistency with the UDC, the City Council approves the request to re -designate the project site and specifically APN: 2836-015-029 from Business Park (BP) to Residential Moderate (RM). SECTION 4. This Ordinance shall be in full force and effect thirty (30) days from its passage and adoption. SECTION 5. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law. 2 n PASSED, APPROVED, AND ADOPTED this day of 2013.
