HomeMy WebLinkAbout2013-10-08 - AGENDA REPORTS - OSPD NOMINN AND WILLIAMS (2)NEW BUSINESS DATE: SUBJECT: I11160tNyuIONS Agenda Item: 6 CITY OF SANTA CLARITA AGENDA REPORT City Manager Approval Item to be presented by: October 8, 2013 Darren Hernandez OPEN SPACE PRESERVATION DISTRICT —NOMINN AND WILLIAMS PURCHASES Administrative Services RECOMMENDED ACTION City Council approve a fund reconciliation to exchange unrestricted funds used to purchase properties within the benefit area boundary of the Open Space Preservation District (OSPD) with the funds used to purchase the Williams parcels and the Nominn parcels located beyond the benefit area boundary. BACKGROUND In June 2012 and April 2013, the properties known as the Nominn and Williams properties were acquired as part of the preservation efforts to secure parcels located within the Conceptual Area Protection Plan (CAPP) of the eastern greenbelt. The Nominn property is 1,030 +/- acres of real property in the Soledad Canyon area, and the Williams property is 56.4 +/- acres of real property in Soledad Canyon. A percentage of Open Space Preservation District funds were used for the acquisitions, because staff believed at that time that the OSPD benefit area boundary is extended upon the purchase of open space parcels and that a purchase of property using OSPD funds is permitted when a portion of the purchase is within the benefit area boundary. Furthermore, both properties meet the guidelines outlined in the Open Space Acquisition Implementation Work Program and other relevant technical documents considered to prioritize properties for land acquisition. The Nominn and Williams parcels are located in a key area of the Eastern Region, specifically the Conceptual Area Protection Plan (CAPP), which increases the connectivity of the wildlife corridor and segmented portions of the Angeles National Forest. The Financial Accountability and Audit Panel (FAAP) requested a review of the Nominn and Williams open space land purchases in relation to the location of the properties with regard to the OSPD three-mile benefit area and funding source used for the two acquisitions. Upon further review, consideration, and consultation with the City Attorney, Assessment Engineer, and Special Counsel for Proposition 218/13ond Counsel, it has been determined that the benefit area does not extend with additional open space acquisitions; consequently, only a portion of the Nominn property is included within the boundary, and the Williams property is entirely outside. Therefore, the Williams property is not eligible for financing using OSPD funds, and with regard to the Nominn property, only the parcel located within the benefit area boundary is eligible for purchase using OSPD funds. To resolve the matter of funding the Nominn and Williams purchases, staff proposes a fund reconciliation to exchange unrestricted funds used to purchase properties located within the benefit area boundary with the OSPD funds used to purchase the Williams parcels and the Nominn parcels located beyond the benefit area boundary. This approach has been reviewed and approved by the City Attorney, Special Counsel for Proposition 218/13ond Counsel, Assessment Engineer, and the City's Independent Auditor. The approval of the proposed fund reconciliation will ensure that OSPD funds expended to date will have been used only for acquisitions located within the three-mile benefit area boundary. Staff will ensure that future open space purchases financed by the Open Space Preservation District are within the three-mile benefit area boundary. ALTERNATIVE ACTIONS Other action as determined by City Council. FISCAL IMPACT There is no fiscal impact to the General Fund or any other fund as a result of the recommended action.
