HomeMy WebLinkAbout2013-03-12 - AGENDA REPORTS - TAX DEFAULTED PROPERTIES OSP (2)Agenda Item: 3 CITY OF SANTA CLARITA AGENDA REPORT CONSENT CALENDAR City Manager Approval: Item to be presented by: Rick Gould DATE: March 12, 2013 SUBJECT: RESOLUTION AUTHORIZING THE SUBMITTAL OF A CHAPTER 8 AGREEMENT TO PURCHASE TAX -DEFAULTED PROPERTIES FOR OPEN SPACE PRESERVATION DEPARTMENT: Parks, Recreation, and Community Services RECOMMENDED ACTION City Council adopt a resolution authorizing the submittal of a Chapter 8 Agreement to the County of Los Angeles Treasurer and Tax Collector to purchase tax -defaulted properties for open space preservation. BACKGROUND The provisions of Chapter 8 of the Los Angeles County Revenue and Taxation Code state that governing agencies may enjoy priority to purchase tax -defaulted properties for public use purposes prior to, or while the properties are publicly auctioned by the County. The County typically conducts two auctions per year. As a public agency, the City of Santa Clarita has the ability to acquire tax -defaulted properties in lieu of participating in the auction process. The Assessors Parcel Numbers for the properties included in the Chapter 8 Agreement being submitted are 2826-125-001, 2848-009-041, and 2848-036-008. One of these properties is a 10 -acre parcel in the County that is adjacent to existing protected land west of the I-5 Freeway and south of Pico Canyon Road. The other two parcels, totaling 52 acres, are contiguous to and directly south of the Golden Valley Open Space, which would increase trail opportunities for hikers, cyclists, and equestrians. The City currently owns more than 7,200 acres of open space. Acquisition of additional properties provides important trail linkages, enhances wildlife connections, and expands the City's greenbelt buffer. Adopt: Re_, 13-io i In order to complete the Chapter 8 requirements, the City must execute the Chapter 8 Agreement and forward it with the approved resolution to the County. Once the County has completed their required process, which can take up to one year, the City will be notified of the total amount due for each parcel. Staff would then return to the City Council with a report detailing the final costs and make a recommendation regarding final approval for each parcel requested. A resolution authorizing submittal of a Chapter 8 Agreement to the County of Los Angeles Tax Collector was adopted previously by City Council, however, the assessors parcel numbers were not included on the resolution as the County did not require them to be included on the resolution at the time. The adoption of this new resolution with the assessors parcel numbers included would rescind, in its entirety, Resolution No. 12-1 adopted on January 10, 2012. This new resolution would replace Resolution No. 12-1. ALTERNATIVE ACTIONS Other direction as determined by the City Council. FISCAL IMPACT There are no costs associated with the approval of this resolution. ATTACHMENTS Resolution RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, AUTHORIZING THE SUBMITTAL OF A CHAPTER 8 AGREEMENT TO PURCHASE TAX DEFAULTED PROPERTY FOR OPEN SPACE PRESERVATION WHEREAS, the City Council of the City of Santa Clarita recognizes the importance of protecting open space; and WHEREAS, the City of Santa Clarita is eligible to purchase real property under the provisions of Division 1, Part 6, Chapter 8 of the Revenue and Taxation Code to acquire title to such properties; and `. WHEREAS, in 2007, the City of Santa Clarita's residents approved the formation of the Open Space Preservation District, which provides the funding to purchase open space, and will fund a portion of the total purchase price for property acquired through the Chapter 8 process. NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby resolve as follows: SECTION 1. The City Manager of the City of Santa Clarita or designee is authorized to execute a Chapter 8 Agreement for Assessor's Parcel Numbers: 2826-125-001, 2848-009-041 and 2848-036-008, which were listed in the 2012A County of Los Angeles Tax Collector Tax Defaulted Property Sale Book. SECTION 2. The City Clerk shall certify to the adoption of this Resolution.
