SUBJECT: APPROVAL OF FINAL TRACT MAP, ACCEPTANCE OF
OFFERS OF DEDICATION, REJECTION OF IRREVOCABLE
OFFER OF DEDICATION FOR TRACT NO. 60258-01, FIVE
KNOLLS (FORMERLY KEYSTONE), AND APPROVAL OF
COVENANT AND AGREEMENT TO DEVELOP PROPERTY TO
INCLUDE COMPONENTS OF COMMUNITY BENEFIT

RECOMMENDED ACTION
City Council:
1. Approve Final Tract Map for Tract No. 60258-01.
2. Accept on behalf of the public the offers of dedication of the easements for public use and
road purposes; the easements for sanitary sewer and sanitary sewer ingress and egress
purposes; all sanitary sewers and appurtenant structures; the easements for covered storm
drain, appurtenant structures, ingress and egress purposes; easements for public use and trail
purposes; the right, but not the obligation, to prohibit any and all allowable uses within open
space; the right to restrict direct vehicular ingress and egress to Golden Valley Road; the
easements for flood control purposes; and the easements for ingress and egress purposes.
3. Reject irrevocable offer of dedication for ownership of Lot 7.
4. Make findings as follows: (a) this project is consistent with the provisions of Sections 66474
and 66474.1 of the Subdivision Map Act and should be approved, and (b) this proposed
subdivision, together with the provisions for this design and improvement, is consistent with
the General Plan required by Article 5 (commencing with Section 65300) of Chapter 3 of
Division 1 of the Government Code.
5. Instruct the Deputy City Manager to endorse the Special Assessment Statement (Statement)
on the face of Final Tract Map for Tract No. 60258-01, which indicates all special
assessments levied by the City of Santa Clarita are paid.
6. Instruct the City Clerk to endorse the Statement on the face of Final Tract Map for Tract No.
60258-01, which embodies the approval of said map and the acceptance of the dedications
shown thereon, and the rejection of the irrevocable offer of dedication shown thereon.
7. Instruct the City Engineer to endorse the Statement on the face of Final Tract Map for Tract
No. 60258-01, which provides for verification of substantial conformance with the Tentative
Tract Map and all provisions of local ordinances and state laws applicable at the time of
approval.
8. Approve the Covenant and Agreement to develop property to include components of
community benefit; and authorize the City Manager, or assigned designee, to execute the
Covenant and Agreement.
BACKGROUND
The Final Tract Map for Tract No. 60258-01, attached hereto, has been reviewed by staff and
found to be in substantial conformance with the principles and standards required by the Unified
Development Code and State Subdivision Map Act. It was approved as a tentative tract map by
the Planning Commission on April 16, 2013. The Final Tract Map consists of approximately
108.65 acres and is located on Golden Valley Road north of Newhall Ranch Road. The map
consists of twenty-nine lots and allows for 380 residential units. At this time, all parcels are
vacant.
Pursuant to Section 66474.1 of the Subdivision Map Act, a legislative body shall not deny
approval of a final or parcel map if it was previously approved as a tentative tract map for the
proposed subdivision and if it finds the final map is in substantial compliance with the previously
approved tentative tract map.
The Final Tract Map was reviewed to the satisfaction of the City Engineer and found to be in
substantial conformance with the previously approved tentative tract map. The conditions of
approval established by the City of Santa Clarita (City) were also met and fees have been and/or
will be paid as indicated on the attached Fact Sheet. Bridge and Thoroughfare fees are required to
be paid prior to issuance of building permits. Therefore, the Final Tract Map is ready for City
Council approval, acceptance of the dedications, and rejection of the irrevocable offer of
dedication.
Furthermore, a Covenant and Agreement has been prepared to ensure that the future development
of the former school site, south of Golden Valley Road, (Lots 127 and 128 of Tentative Tract
Map No. 60258), is developed to include components of community benefit as intended with the
original tentative tract map, approved by City Council on April 25, 2006. The Covenant and
Agreement attached has been reviewed by the City Attorney and is ready for City Council
approval for its execution.
ALTERNATIVE ACTIONS
Staff has not identified alternative actions that would conform to requirements set forth in the
Subdivision Map Act.
FISCAL IMPACT
The public streets shown on the Final Tract Map for Tract No. 60258-01 will be dedicated to the
City of Santa Clarita. The maintenance of these streets will have minimal impact on the City's
street maintenance budget. The developer shall pay Bridge and Thoroughfare fees in place prior
to issuance of building permits.

building permits.
School Fees: All applicable school fees will be paid prior to issuance of building permits.

COVENANT AND AGREEMENT
Ermine Street LLC hereby enters into this covenant and agreement ("Covenant and Agreement")
and hereby certifies it is the owner (the "Owner") of the hereafter legally described real property
located in the City of Santa Clarita, County of Los Angeles, State of California, described as
follows:
Revised Vesting Tentative Tract No. 060258, Lot 127 and 128, formerly known as Lot 102, a
metes and bounds description of which is set forth on Exhibit A hereto (the "Property).
Consistent with the City of Santa Clarita's (the "City") approval of Tract No. 060258, we do
hereby promise, covenant and agree to and with the City of Santa Clarita that when the Property
is developed, the Property shall be developed to include components of community benefit
(including by way of example, but without limitation, a school, or a recreation or community
center or facility such as a YMCA).
The Owner intends that the covenants and agreements set forth herein shall run with the land and
shall be binding upon any future owners or encumbrancers of the Property, their successors, heirs
andassigns and shall continue in effect until the Property is developed in accordance with this
Covenant and Agreement. The Owner agrees that in the event that a determination is made that
the covenants herein do not run with the land, such covenants shall be enforceable as equitable
servitudes against the Property in favor of the City.
The City shall be a beneficiary of this Covenant and Agreement, with the right, but not the
obligation to enforce the terms herein. This Covenant and Agreement may only be amended or
rescinded with the written consent of the Owner and the City. The Owner and the City agree to
execute any necessary documents to remove this Covenant and Agreement from title upon
development of the Property in accordance with this Covenant and Agreement.
