SUBJECT: FORMATION OF DRAINAGE BENEFIT ASSESSMENT AREA
NO. 2014-1 RIVER VILLAGE AREA C (TRACT 53425 AREA C)

RECOMMENDED ACTION
City Council:
Adopt a resolution to initiate proceedings to form Drainage Benefit Assessment Area No.
2014-1 River Village Area C to benefit parcels in Tract 53425 Area C and to approve the
Engineer's Report.
2. Set a public hearing for December 9, 2014, as a time and place to hear comments on the
proposed action, and close the time period to receive ballots.
BACKGROUND
On May 24, 2005, the City Council approved the final set of development conditions for River
Village (approved under the name of Riverpark) Tract Map 53425. Within this tract is Area C,
which was sold by Newhall Land to Beazer Homes. River Village Area C was approved for 380
multi -family units. Area C is approximately 42.5 acres and located in the northeast corner of the
project area. (See attached map.)
As a condition of approval and as a mitigation measure identified by the Environmental Impact
Report, a water -quality basin was required for Area C by the Urban Storm Mitigation Plan
(USMP) to reduce the amount of pollutants in urban runoff prior to its discharge. To this end,
the developer was required to form a special district, whereby the cost of maintaining the
water -quality basin would be paid by the benefiting property owners.
Drainage Benefit Assessment Area No. 2014-1 (DBAA 2014-1) will be responsible for
administering the maintenance, reporting, monitoring, inspection, storm -damage repair, and
cleaning of storm -drain improvements which encompass this water -quality basin. For reference
purposes, a water -quality basin is an extended dry detention area inclusive of wetlands and
landscaped with native vegetation.
Extended detention basins are areas whose outlets have been designed to detain stormwater
runoff for some minimum time (e.g., 48 hours) to allow particulate and associated pollutants to
settle. DBAA 2014-1 will manage and fund required operational tasks such as regular
maintenance, vegetation control, sediment removal, professional reporting, permit handling,
water -quality testing, and annual reports. Additionally, a reserve fund will be established for
operations and hazardous material removal, should such a need ever arise.
The Engineer's Report contains the proposed boundaries of DBAA 2014-1, identifies the
proposed facilities and services to be funded, determines the general and special drainage
benefits received by properties, and establishes the methodology to apportion the annual
assessments. All parcels were established concurrently to the conditions set forth for the
continued maintenance of the landscape and infrastructure improvements, and as a result, each
parcel within DBAA 2014-1 receives a special and distinct benefit from the improvements.
The annual assessment to maintain the improvements associated with DBAA 2014-1 will be
$54,316. Based on the number of units approved for construction, the annual assessment for a
single-family detached residence will be $304.37 per unit, while the annual assessment for a
attached townhome will be $183.13 per unit.
The maximum assessment rate will adjust each year based on the annual change in the Consumer
Price Index, all Urban Consumers, for the Los Angeles Riverside -Orange County Area ("CPI").
The actual assessment levied in any fiscal year will be approved by the City Council and may not
exceed the maximum assessment rate. The City will begin levying properties commencing in
Fiscal Year 2015-16.
ALTERNATIVE ACTIONS
1. Do not adopt a resolution to initiate formation of DBAA 2014-1.
2. Other direction as determined by the City Council.
FISCAL IMPACT
The cost to prepare the Engineer's Report and create DBAA 2014-1 is estimated to be $8,500.
While the City by law is responsible for retaining an assessment engineering firm to oversee the
creation of the DBAA, the property owner is financially responsible for all costs associated with
these actions. The property owner has deposited funds into a pass-through account, which is
overseen by the Administrative Services Department and utilized to cover costs incurred by the
assessment engineer to create this DBAA.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA CLARITA, CALIFORNIA, APPROVING AN ENGINEER'S REPORT
AND DECLARING ITS INTENTION TO ORDER THE FORMATION OF A
DRAINAGE BENEFIT ASSESSMENT AREA AND TO LEVY AN
ASSESSMENT THEREON, AND TAKING CERTAIN OTHER ACTIONS IN
CONNECTION THEREWITH
WHEREAS, the City Council of the City of Santa Clarita (the "City") desires to form an
assessment district (the "District) pursuant to the provisions of the "Benefit Assessment Act of
1982," being Article 4 of Chapter 6.4 of the Government Code (commencing with Section
54703) (the "Act") and in accordance with Article XIIID of the California Constitution and the
Proposition 218 Omnibus Implementation Act (commencing with Section 53750 of the
California Government Code) to fund the cost of maintenance and operation of the storm drain
box culvert required for River Village Area C, Tract 53425 Area C; and
WHEREAS, the boundaries of the proposed District shall be set forth in the Assessment
Diagram as shown on the map presented to this Council and on file with the Special Districts
Office and incorporated herein by reference; and
WHEREAS, the title of the proposed District shall be "Drainage Benefit Assessment
Area No. 2014-1 (River Village Area C);" and
WHEREAS, the City has approved a consulting engineer's contract with Harris &
Associates, naming Harris & Associates as the Assessment Engineer and firm responsible for
preparing the Engineer's Report and assisting in the public hearing and formation process for the
proposed District; and
WHEREAS, the Engineer's Report has been duly presented by the Special Districts
Office for consideration and has been fully considered by the City Council.
NOW THEREFORE, the City Council of the City of Santa Clarita, California, does
hereby resolve as follows:
SECTION 1. The above recitals are true and correct.
SECTION 2. The Engineer's Report, including the plans, specifications, general
descriptions, and estimates of the cost of the proposed services, the boundary diagram and the
proposed assessments, is hereby approved as filed and incorporated herein by this reference. The
Engineer's Report shall stand as the report for the purpose of all subsequent proceedings under
the Act and Article )IIID, except that it may be confirmed, modified, or corrected as provided in
the Act.
SECTION 3. The City Council hereby finds that the public interest, necessity, and
convenience require the construction and maintenance of the improvements to reduce the amount
of pollutants in urban runoff prior to its discharge into the Santa Clara River. The City Council
hereby declares its intention to form an assessment district to be known as the "Drainage Benefit
Assessment Area No. 2014-1 (River Village Area C)." The boundaries of the District shall cover
the real property benefited by the services funded by the assessment as shown on and described
on the map entitled, "Drainage Benefit Assessment Area No. 2014-1 (River Village Area C)
Assessment Diagram," on file with the Special Districts Office and incorporated herein by
reference. The City Council hereby declares and fmds the land within the boundaries of the
District to be specially benefited by the improvements and/or the maintenance thereof.
SECTION 4. The purpose of the District is to fund the maintenance and operation of the
storm drain box culvert required for River Village Area C, Tract No. 53425 Area C, and is of
benefit to the property within the District. All services and work to be funded by the District
shall be done in accordance with the Engineer's Report on file in the Special Districts Office and
incorporated herein by reference. The Engineer's Report and its exhibits contain a full and
detailed description of the services and the maintenance which may be funded by the District, the
boundaries of the District, and the proposed assessments upon the assessable properties in the
District.
SECTION 5. As set forth in the Engineer's Report, each year the maximum annual
assessment rate will be increased by the annual change in the Consumer Price Index, All Urban
Consumers, for the Los Angeles -Riverside -Orange County Area ("CPI"). The actual assessment
to be levied each year will be as determined by the City Council, not to exceed the maximum
annual assessment rate for such period. If approved, the assessment will be levied beginning in
FY 2015-16.
SECTION 6. The City Council appoints December 9, 2014, at 6:00 p.m., in the Council
Chambers, 23920 Valencia Boulevard, Santa Clarita, California, or as soon thereafter as the
matter may be heard, as the time and place for hearing protests to the proposed District
formation, the proposed levy of assessments, the amount of the individual assessments, and
related matters as set forth in the Engineer's Report, and any interested person may appear and
object to the proposed services, or to the extent of the District or to said proposed assessments.
SECTION 7. The City Clerk is hereby directed to give notice of such hearing by:
a. Mailing notices, together with assessment ballots, postage prepaid, in the United
States mail, in the time, form, and manner provided by Section 53753 of the
California Government Code, to the record owners of property in the proposed
District. Such notice shall be mailed no later than October 24, 2014, and shall be
deemed to have been given when deposited in such mail. Upon the completion of the
mailing of said notices and assessment ballots, the City Clerk is hereby directed to file
with the City Council an affidavit setting forth the time and manner of the compliance
with the requirements of law for mailing said notices and assessment ballots. The
notice shall be mailed not less than forty-five (45) days before the date of the public

hearing ordered herein.
b. Publication once a week for two successive weeks prior to the Public Hearing in a
newspaper published once a week or more often, with at least five days intervening
between the respective publication dates.
c. Posting notice of the Public Hearing in at least three public places within the
jurisdiction of the City.
SECTION 8. The Engineer's Report and other written material about the District may
also be reviewed at the Special Districts Office, 23920 Valencia Boulevard, Santa Clarita,
California, during regular business hours.
SECTION 9. The assessment balloting procedures approved by the City Council
pursuant to Resolution 05-116 adopted on September 27, 2005, shall be the procedures for the
completion, return, and tabulation of assessment ballots for the proposed District.
SECTION 10. This Resolution shall take effect immediately.
SECTION 11. The City Clerk shall certify to the passage and adoption of this
Resolution, cause the same to be entered in the book of resolutions of the City, and make a
minute of the passage and adoption thereof in the records of the proceedings of the City Council
of the City in the minutes of the meeting at which the same is presented.

which this Report applies. The Assessor's maps and records are incorporated by reference herein and

An assessment of the estimated cost of the improvements on each benefited lot or parcel of land
within the Assessment District.

METHOD OF ASSESSMENT
The method of apportionment of assessments, indicating the proposed assessment of the net amount
of the costs and expenses of the improvements to be assessed upon the several lots and parcels of
land within the Assessment District, in proportion to the estimated benefits to be received by such
lots and parcels.

PART A
Plans and Specifications
The proposed services involve the maintenance and operation of the one (1) water quality basin
(extended detention basins) required for River Village Tract No. 53425 Area C by the Urban Storm
Mitigation Plan (USMP), the facilities shown as not maintained by LACFLD in the Storm Drain
Improvement Plans for Tract 53425, M.T.D. No. 1819, Sheet 3A, and the project mitigation measures
outlined in the Environmental Impact Report to reduce the amount of pollutants in urban runoff prior
to its discharge into the Santa Clara River. The basins treat runoff from portions of the River Village
development. The water quality basin is an extended dry detention basin with wetland that is
vegetated and landscaped with native vegetation. Extended detention basins are basins whose outlets
have been designed to detain the storm water runoff for some minimum time (e.g. 48 hours) to allow
particles and associated pollutants to settle. Additionally, the basins have been designed to reduce the
2 -year peak flow from the post -development condition to the pre -development condition. The
difference in the pre -and post -development Stormwater runoff generated by a 2 -year storm, and by a
0.75 -inch (first flush) storm, will be collected, detained, and treated in the basins, before it is released
into the Santa Clara River. Regular maintenance is required in order for the basins to function
correctly within the design parameters.
The services necessary for the District include, but are not limited to, and may be generally described
as: 1) silt/debris removal, 2) landscaping replacement, 3) replacement of piping and gravel media as
needed, 4) storm damage repair, and 5) annual review with a report and recommendations.
Plans and Specifications for the improvements for the District are voluminous and are not bound in
this report, but by this reference are incorporated and made a part of this report. The plans and
specification are on file at the City where they are available for public inspection.

PART B
Estimate of Cost
The Benefit Assessment Act of 1982 (hereinafter "the Act') provides that the estimated costs of the
improvements shall include the total cost of the improvements for Fiscal Year 2014-15, including
incidentals, which may include reserves to operate the District until funds are transferred to the City from
the County around December 10 of the next fiscal year.
The Act also provides that the amount of any surplus, deficit or contribution be included in the
estimated cost of improvements. The net amount to be assessed on the lots or parcels within each
district is the total cost of maintenance and servicing with adjustments either positive or negative for
reserves, surpluses, deficits, and/or contributions.
The following table shows the estimated costs of improvements for the District.

A Future/Reserve fund is being established for the District to cover the first six months of expenses
annually before collection from the County has been received, as well as unexpected expenses. The
funds will be allowed to build up gradually in anticipation of any maintenance costs that can and do
occur when there is a great amount of rainfall during the year.

The boundary diagram for the District is included herein as Appendix A, and is part of this report.
The lines and dimensions of each lot or parcel within the District are those lines and dimensions
shown on the maps of the Assessor of the County of Los Angeles for the fiscal year to which this
Report applies. The Assessor's maps and records are incorporated by reference herein and made part
of this Report.
PART D
Assessment Roll
All assessed lots or parcels of real property within the District are listed on the Assessment Roll. The
Assessment Roll states the net amount to be assessed upon assessable lands within the District for
Fiscal Year 2014-15, shows the Fiscal Year 2014-15 assessment upon each lot and parcel within the
District, and describes each assessable lot or parcel of land within the District. These lots are more
particularly described in the Assessment Roll, which is included in this Report as Appendix B. The
list is keyed to the records of the Assessor of the County of Los Angeles which are incorporated
herein by reference.

PART E
Method of Assessment
The following is the assessment methodology for the Assessment District
Background
The Act provides that assessments may be apportioned upon all assessable lots or parcels of land
within an assessment district in proportion to the estimated benefits to be received by each lot or
parcel from the improvements. In addition, Proposition 218 requires that a parcel's assessment may
not exceed the reasonable cost of the proportional special benefit conferred on that parcel. The
Proposition provides that only special benefits are assessable, and the City must separate the general
benefits from the special benefits conferred on a parcel. A special benefit is a particular and distinct
benefit over and above general benefits conferred on the public at large, including real property
within the District. The general enhancement of property value does not constitute a special benefit.
Special Benefit
In the development the drainage improvements were installed by the developers, subdividers of the
land, and the continued maintenance was guaranteed through the establishment of a Drainage Benefit
Assessment Area. If the installation of the improvements and the guaranteed maintenance did not
occur, the development would not have been established and could not have been sold to any distinct
and separate owner. The establishment of a buildable lot is a special benefit which permits the
construction of a building or structure on the property and the ownership and sale of the distinct lot in
perpetuity.
All the lots are established at the same time once the conditions regarding the improvements and the
continued maintenance are guaranteed. As a result, each lot within the District receives a special and
distinct benefit from the improvements. River Village Tract No. 53425 Area C is comprised of multi-
family residential developments and a private road. These parcels are assessed based on the specific
drainage area of each proposed lot. There is a total of 26.29 acres in the drainage sub -basin within
the tract.
General Benefit
In addition to the special benefits received by the parcels within the District, there are incidental
general benefits conferred by the proposed improvements. All general benefits, if any, to the
surrounding community and public in general from maintenance of these local water quality basins
are nominal, intangible and are not quantifiable.
Apportionment
All parcels within the District receive special benefit from the improvements based on the amount of
storm water runoff from the parcel to the water quality basin improvements. Therefore, each parcel
is assessed an amount based on the drainage area of the parcel, which directly correlates to the
amount of storm water runoff from each parcel.
Based on the approved Hydrology Study, dated September, 2010, the following are the drainage
areas within the development boundary contributing to the water quality basin.

Assessment Rates

The table below provides the projected assessment apportionment for the two types of planned
residential unit areas within the River Village Area C development and shows the estimated
maximum annual assessment rate per residential unit given the following assumptions. These rates
are based on the following development scheme: 12.38 drainage acres currently designated for 87
single family residential (SFR) units, 12.71 drainage acres currently designated for 152 single family
attached condominium (CON) units, and 1.2 drainage acres for the recreation center which is
common area.
Since the recreation center is common area for the entire development and equally owned by each
unit, the maximum assessment for the recreation center of $2,479.25 has been divided equally among
all 239 units, which equals $10.37 per unit.
