SUBJECT: METRO BILLBOARD REDUCTION AGREEMENT

RECOMMENDED ACTION
City Council, by motion, declare the Council will not approve the second reading of the two
ordinances associated with the Los Angeles County Metropolitan Transportation Authority
(METRO) Billboard Reduction Agreement, and deem the METRO project application denied.
BACKGROUND
At the February 25, 2014, City Council meeting, the City Council voted 3-1 to introduce for first
reading of two ordinances associated with an application brought by METRO concerning a
billboard removal and relocation program. The Council vote included modifications to the
ordinances, which METRO staff present at the Council meeting agreed to. Subsequent to that
meeting, and in the context of finalizing the ordinances for the Council's consideration of the
second reading and possible adoption, various METRO staff members had contact with City staff
and indicated that METRO staff was not willing to recommend that the METRO Board approve
the Development Agreement and Lease as modified by the City Council. More specifically,
METRO staff expressed concern regarding the indemnification provisions pertaining to
automobile accidents allegedly caused by the billboards. Based upon the fact that it appears that
METRO is not willing to agree to the Council's revised indemnification language, City staff
cannot recommend that the Council approve the two ordinances at this time.
Staff would recommend that the Council indicate by an adopted motion that the Council will not
be giving second reading to the ordinances, and deems the project application denied, in order to
provide clear direction to METRO that at this point any further negotiation will necessitate a new
project application from METRO.

ALTERNATIVE ACTIONS
If METRO staff indicates a willingness to move forward with the language as modified by the
City Council, the City Council could direct that the ordinances be brought back for second
reading at the next City Council meeting (March 25, 2014).
