Home My WebLink About2014-12-09 - AGENDA REPORTS - SC SPECIAL ELECTION RESULTS (2)CONSENT CALENDAR DATE: SUBJECT: DEPARTMENT: Agenda Item: 7 CITY OF SANTA CLARITA AGENDA REPORT OAF City Manager Approval: Item to be presented by: December 9, 2014 DECLARING RESULTS OF CITY OF SANTA CLARITA SPECIAL ELECTION Administrative Services RECOMMENDED ACTION City Council adopt a resolution reciting the fact of the Special Election held on November 4, 2014, declaring the result of City of Santa Clarita Measure S and such other matters as provided by law. BACKGROUND By Resolution No. 14-55, adopted on June 24, 2014, the City Council called and gave notice of the holding of a special election to submit to the voters of the City of Santa Clarita, Ordinance 14-02, for the purpose of voting on a referendum ballot measure, and requesting the Board of Supervisors to consolidate said special election with the November 4, 2014, statewide general election and permit the County Registrar -Recorder to render certain services to the City of Santa Clarita for said election. In accordance with Elections Code Sections 10262 and 10263, upon receipt of the results of the election from the elections official conducting the election (Los Angeles County Registrar-Recorder/County Clerk), the city elections official (City Clerk) shall certify the results to the governing body (City Council) no later than the next regularly scheduled City Council meeting following presentation of the 28 -day canvass of the returns. On November 28, the Los Angeles County Registrar-Recorder/County Clerk certified the results of the general election. On December 2, 2014, the Los Angeles Board of Supervisors declared the election results official. A resolution reciting the facts of the special election has been prepared for Council consideration and includes the Los Angeles County Registrar-Recorder/County Clerk's Certificate of Canvass. ALTERNATIVE ACTIONS No other actions have been determined. FISCAL IMPACT There is no fiscal impact associated with this action. ATTACHMENTS Resolution Attachment to Resolution -Certificate of Canvass RESOLUTION NO. 14- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, RECITING THE FACT OF THE SPECIAL ELECTION HELD ON TUESDAY, NOVEMBER 4, 2014, FOR THE PURPOSE OF VOTING ON A REFERENDUM BALLOT MEASURE TO APPROVE AN ORDINANCE ADOPTING A DEVELOPMENT AGREEMENT WITH LOS ANGELES COUNTY METROPOLITAN AUTHORITY (METRO) FOR THE REMOVAL OF 62 OFF-SITE ADVERTISING STRUCTURES, AND CONSTRUCTION AND OPERATION OF THREE DIGITAL BILLBOARDS ADJACENT TO THE INTERSTATE 5 AND STATE ROUTE 14 FREEWAYS, AND DECLARING THE RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS, a consolidated Special Election, as part of the Los Angeles County General Election, was held and conducted in the City of Santa Clarita, California on Tuesday, November 4, 2014, as required by law; and WHEREAS, the Los Angeles County Registrar-Record/County Clerk canvassed the returns of the election and has certified the results to this City Council, the results are received, attached, and made a part hereof as "Exhibit A." NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA DOES HEREBY RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOWS: Section 1. That the whole number of ballots cast in the City except mail -in voter ballots and provisional ballots were 23,622. That the whole number of Vote by Mail and Provisional ballots cast in the City was 18,679 making a total of 42,301 votes cast in the City. Section 2. That the ballot question, Measure S, stated "Shall Ordinance No. 14-02 adopting a Development Agreement with the Los Angeles County Metropolitan Transportation Authority (METRO) for the removal of 62 advertising structures, within the City, by METRO or any other means, and construction and operation of three digital billboards, adjacent to the Interstate 5 and State Route 14 freeways, and the dedication to the City of revenue received from digital billboards, which creates an ongoing revenue stream, be adopted? Yes/No" Section 3. That the number of votes given at each precinct and the number of votes given in the City for the ballot measure are as listed in the Certificate of Canvass (Exhibit A) attached. As Measure S was not adopted by a majority vote of the electors, per Elections Code section 9241 Ordinance 14-02 will not got into effect. 3 Section 4. The City Clerk shall enter on the records of the City Council of the City, a statement of the result of the special election, showing: 1) the whole number of votes cast in the City, 2) the number of votes given at each precinct for and against the measure, and 3) the total number of votes given in the city for and against the measure. Section 5. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
