HomeMy WebLinkAbout2014-06-24 - RESOLUTIONS - REFERENDUM PETITION ORD 14-02 (4)RESOLUTION NO. 14-54 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, ACCEPTING THE CITY CLERK'S CERTIFICATE OF SUFFICIENCY FOR REFERENDUM PETITION RELATING TO ORDINANCE NO. 14-02 REGARDING DEVELOPMENT AGREEMENT WITH METRO. WHEREAS, on March 25, 2014, the City Council Adopted Ordinance No. 14-02 adopting a Development Agreement with Los Angeles County Metropolitan Transportation Authority (METRO) for the removal of 62 off-site advertising structures, and construction and operation of three digital billboards adjacent to the Interstate 5 and State Route 14 freeways (Ordinance 14-02 or Ordinance); and WHEREAS, the City Clerk attested to the Ordinance on April 3, 2014; and WHEREAS, on May 5, 2014, the City Clerk (Elections Official) received a Referendum Petition against Ordinance No. 14-02; and ' WHEREAS, after a prima facie review by the City Clerk, the referendum was deemed filed on May 5, 2014; and WHEREAS, pursuant to Elections Code section 9237, a referendum petition must be signed by at least 10 percent of the registered voters in the City based upon the County Election Official's last official report of registrations to the Secretary of State; and WHEREAS, it has been determined that the Los Angeles County Registrar's last official report of registration to the Secretary of State for the City of Santa Clarita was 111,697 registered voters and that 10% of said registration would require 11,170 valid signatures to qualify the referendum petition; and WHEREAS, on June 6, 2014 the Los Angeles County Clerk/Registrar of Voters determined that the Referendum Petition contained 11,370 valid signatures and notified the City Clerk as; and WHEREAS, the City Clerk has prepared the Certificate of Sufficiency of Referendum Petition attached as Exhibit A; and WHEREAS, Elections Code section 9114 requires that referendum petitions must be submitted to the City Council at the next regular City Council meeting following the ' certification. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Santa Clarita that the City hereby accepts the Certificate of Sufficiency for the Referendum Petition prepared by the City Clerk for the Referendum Petition against Ordinance No. 14-02, a copy of which Certificate is attached hereto as Exhibit "A". That pursuant to Election Code Section 9237, it has been determined that the Los Angeles County Registrar's last official report of registration to the Secretary of State for the City of Santa Clarita was 111,697 registered voters and that 10% of said registration would require 11,170 valid signatures to qualify the referendum petition. That in accordance with Election Code Section 9210(b), it was determined that said petition contained sufficient signatures to be accepted (prima facie count.) Pursuant to Elections Code Section 9211, petition signatures were examined by the Los Angeles County Registrar as per Election Code Section 9114, and that Office has determined that 11,370 signatures were valid. The signature verification letter from the County is attached hereto. Therefore, the referendum petition against Ordinance No. 14-02 submitted by the proponents is deemed to be sufficient. In accordance with Elections Code Section 9114 I am providing the results of the petition to the City Council.
