SUBJECT: REAL PROPERTY ACQUISITION OF 59.60 +/- ACRES IN
QUIGLEY CANYON, ASSESSOR'S PARCELS NOS. 2833-024-038
AND 039

RECOMMENDED ACTION
City Council:
1. Approve the purchase of 59.60 +/- acres in Quigley Canyon, Assessor Parcel Nos. 2833-024-
038 and 039, at a total cost of $783,000, which includes the property purchase price of
$718,000, and $15,000 for escrow, title, surveying fees and due diligence costs. and $50,000
for gates, fencing and signage.
2. Appropriate $439,800 from Open Space Preservation District Fund Balance (Fund 358) to
Open Space Preservation District Expenditure Account 12592-5201.004.
Appropriate $50,000 from Open Space Preservation District Fund Balance (Fund 358) to
Open Space Preservation District Expenditure Account 12592-5201.008.
4. Appropriate $293;200 from Via Princessa Bridge & Thoroughfare District Fund Balance
(Fund 302) to Expenditure Account 14405-5201.004.
Authorize the City Manager, or designee, to execute all documents, subject to City Attorney
approval.
BACKGROUND
The subject property is located in Quigley Canyon and is adjacent to the City's existing 185 +/-
acres of open space. Acquisition of this property will ensure trail connectivity between other
existing trails on City owned property, and increase the City's network of trails in Quigley
Canyon.

In 2007, staff communicated with the property owner, Ida Pryor, to determine if there was an
opportunity to purchase the property; however, the negotiations were not successful. Since then,
the majority of the ownership has been transferred into the Estate of Ida Pryor, and negotiations
to acquire the property resumed.
In November 2014, the representatives of the estate had the property appraised, which was
valued at $718,000,.and the trustee approached the City with an offer to sell. The property
generates income from a Lease and Surface Use Agreement with Barry Petroleum, which was
recently acquired by Linn Energy. These agreements generate income of about $40,000 per
year, and the City will assume the existing agreements and the future revenues as part of this real
property acquisition.
Similar to other acquisitions in Quigley Canyon, a portion of the funding is derived from the Via
Princessa Bridge and Thoroughfare District to accommodate future transportation impacts in the
area.
It has been reviewed pursuant to the California Environmental Quality Act (CEQA) and the
acquisition is exempt under CEQA Section 15313, Class 25, as a transfer of an ownership
interest in land to preserve open space and existing natural conditions. Any subsequent or
proposed changes in the use on condition of the property will be subject to CEQA guidelines.
ALTERNATIVE ACTION
I. Direct staff to cease purchase of the property.
2. Other action as determined by the City Council.
FISCAL IMPACT
Upon approval of the requested appropriations there will be sufficient funds available for the
acquisition of 59.60 +/- acres in Quigley Canyon, Assessor's Parcel Nos. 2833-024-038 and 039,
which includes the property purchase price of $718,000, $15,000 for escrow, title, surveying fees
and due diligence costs, and $50,000 for gates, fencing and signage. Requested appropriations
include $489,800 from the Open Space Preservation District (Fund 358) and $293,200 from the
Via Princessa Bridge and Thoroughfare District (Fund 302).
